HomeMy WebLinkAbout86-25 - ADMIN Resolution - City Council - 1986/02/18February 18, 1986 RESOLUTION NO. 86-25 RESOLUTION AUTHORIZING PURCHASE OF PROPERTY FOR THE EXCELSIOR BOULEVARD WIDENING PROJECT WHEREAS, the City Council of St. Louis Park has authorized and directed the City Manager to negotiate with the owners of property for the purchase of necessary Quit Claim Deeds and construction easements for the construction of the project. WHEREAS, pursuant to such negotiations, the following have indicated their desire to sell said property to the City by Quit Claim Deed for a permanent easement for highway purposes and a construction easement. NOW THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park that The City of St. Louis Park purchase at the price indicated the following described property in Hennepin County, Minnesota to -wit: Neola S. Reed, an undivided 1/2 interest (S10) $3,150.00 Delphine S.Roberts,an undivided 1/2 interest (S9) 2,200.00 Permanent Eastment A permanent easement for highway purposes over that part of Lot 1, Block 10, Brookside according to the plat thereof on file and of record in the office of the Register of Deeds which lies Northwesterly of the following described line: Beginning at a point on the West line of said Lot 1 distant 5.2 feet South of the Northwest corner thereof; thence Northeasterly parallel with the Northwesterly line of said Lot 1 for a distance of 143 feet; thence deflect right 45 degrees to the Easterly line of said Lot 1 and there terminating. Temporary Easement A temporary construction easement which shall expire October 31, 1986, over that part which lies Southeasterly of the following described line: Beginning at a point on the West line of said Lot 1 distant 5.2 feet South of the Northwest corner thereof; thence Northeasterly parallel with the Northwesterly line of said Lot 1 for a distance of 143 feet; thence deflect right 45 degrees to the Easterly line of said Lot 1 and there terminating and Northwesterly of the following described line: Beginning at a point on the West line of said Lot 1 distant 10.5 feet South of the Northwest corner thereof; thence Northeasterly parallel with the Northwesterly line of said Lot 1 for a distance of 136 feet; thence deflect right 45 degrees to the Easterly line of said Lot 1 and there terminating. The Mayor and City Manager are hereby authorized to execute any and all instruments necessary to complete the purchase of said properties, and the City Manager is hereby authorized and directed to accept delivery of the deeds and pay the indicated sums from the Special Assessment Construction Fund (25-4470-964-70) to said Neola S. Reed and Delphine S. Roberts, delivery by the seller of a Quit Claim Deed - Construction Easement to said property accompanied by an Abstract of Title or Owner's Certificate of Title showing good and marketable title of record to said property, together with an opinion of the Law Department of the City of St. Louis Park approving the execution of the deed and the seller's abstract or certificate.
