HomeMy WebLinkAbout86-184 - ADMIN Resolution - City Council - 1986/11/03RESOLUTION NO. ?IQ 494- A RESOLUTION RESCINDING RESOLUTION NO. 86-122 ADOPTED ON AUGUST 4, 1986, RESCINDING RESOLUTION NO. 85-17 ADOPTED ON FEBRUARY 19, 1985 RESCINDING RESOLUTION NO. 7525 ADOPTED ON DECEMBER 19, 1983, RESCINDING RESOLUTION NO. 7419 ADOPTED ON JULY 5, 1983, AND GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER SECTION 14-156 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW THE CONSTRUCTION OF A 186 -UNIT APARTMENT DEVELOPMENT AT 9935 SHELARD PARKWAY (PREVIOUSLY KNOWN AS BETTY CROCKER DRIVE) FINDINGS WHEREAS, CSM Corporation has made application to the City Council for a special permit under Section 14-156 of the St. Louis Park Ordinance Code to allow the construction of a 186 -unit apartment development at 2555-65-75 Shelard Parkway within a R -B, Residential Business District, having the following legal description: 1 Lot 2, Block 3, Shelard Park (Abstract) 1 WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case No. 83 -6 -SP, 83 -102 -SP, 84 -99 -SP, 86 -56 -SP, and 86 -85 -SP) and the effect of the proposed 186 -unit apartment development on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 86-122 of the St. Louis Park City Council dated February 19, 1985 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now 1 necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 86-122 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 86-122 (filed as Document No. 5152397) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting 186 -unit apartment development within the R -B, Residential Business District at the location described above based on the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A - Site Plan, Exhibit B - Building 1, Exhibit C - Building 2, Exhibit D - Building 3, Exhibit E - Grading Plan, Exhibit F - Utility Plan, Exhibit G - Landscape Plan, except as modified by the conditions which follow. (Exhibits are on file in the City Development Office.) 2. That land for the 13 parking spaces be deeded or a perpetual easement be assigned to Coach Homes 1. 3. That prior to construction, approval be obtained from the Bassett Creek Flood Control Commission if required. 4. That the applicant execute any agreement, if necessary, with the City in connection with implementation of the storm sewer system modifications. 5. That all signage be in accordance with the Sign Policy for Shelard Park, with no sign closer than 25 feet to the lot line. 6. That the east portion of the site plan be modified to provide a minimum of 35 feet between buildings 2 and 3, that additional landscaping be placed along the east lot line (a combination of coniferous and deciduous trees), and that the number of dwelling units be reduced or altered or the building shape be modified to provide at least 35 feet between the buildings, including balcony projections. 7. That no trash or trash containers be stored outside. 8. That all curbing shall be concrete poured in place and measure 6 inches above the grade. 9. That all outdoor lighting shall be directed perpendicular to the ground (unless globe lighting is used) and no lights shall be more than 20 feet off the ground. 10. All rooftop equipment shall be screened. 12. That the development plan and exterior in Condition 1 are hereby modified with respect to the balcony and gable addition as shown on Exhibit I - Balcony Locations, and Exhibits J, K and L - Elevations; and that quality redwood materials be used on the gable and balcony areas. 13. That the site be landscaped in accordance with Exhibit G1 - Landscape Plan instead of Exhibit G - Landscape Plan described in Condition No. 1, and that said landscaping be maintained thereafter. 14. That all improvements including buildings, roadways, parking, garages, parking lots, amenities, landscaping, ponding and utility work be completed by May 15, 1987.
