RESOLUTION NO. 86-174
A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER
SECTION 14-126(4) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO
ZONING TO PERMIT THE CONSTRUCTION OF AN OFF-STREET PARKING LOT
FOR PROPERTY ZONED R-3, TWO FAMILY RESIDENCE DISTRICT, AND B-2,
BUSINESS DISTRICT LOCATED AT 3977 ZARTHAN AVENUE SOUTH
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. 5812 Excelsior Boulevard Company (Whitney E. Peyton) has made application to
the City Council for a special permit under Section 14-126(4) of the St. Louis Park
Ordinance Code for the purpose of constructing an off-street parking lot within a R-3,
Two Family Residence District, and B-2, Business District located at 3977 Zarthan Avenue
South for the legal description as follows, to -wit:
Lots 21, 22 and that part of Lot 23, described as follows, to wit: Beginning at
the southwest corner thereof; thence northwesterly along the southwesterly line
thereof to a point 15.45 feet southeasterly from the northwest corner thereof,
thence northeasterly to a point in the east line thereof distant 10.45 feet south
measured along the east line thereof from the northeast corner thereof; thence
southeasterly along the east line thereof to the southeast corner thereof; thence
southwesterly along the southeasterly line thereof to the point of beginning,

2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 86 -80 -SP) and the effect of the proposed off-street parking lot on
the health, safety and welfare of the occupants of the surrounding lands, existing and
anticipated traffic conditions, the effect on values of properties in the surrounding area,
the effect of the use on the Comprehensive Plan, and compliance with the intent of the
Zoning Ordinance.
3. The Council has determined that the the proposed off-street parking lot will not
be detrimental to the health, safety, or general welfare of the community nor will it
cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed off-street parking lot is in harmony with the general
purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit the construction of an off-street parking lot at the location
described is granted based on the findings -set forth above and subject to the following
conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A - Site
Plan.
2. The fence along the northerly property line shall be of solid material and no higher
than 3.5 feet from the west property to a point 30 feet east of the west property
line, and 6 feet high for the remaining 90 feet.
3. The trees on either side of the driveway may be Locust, Linden or Amur Maple with
a trunk diameter of 3 inches at planting or Spruce with a height of 6 feet at planting.
4. That the parking lot and driveway be delineated by poured in place concrete curbing
measuring six inches above and below grade.
5. That all lighting on the site or from adjacent commercial property be directed
perpendicular to the ground and be located no higher than 10 feet.
6. That trash be placed on the southerly 10 feet of the parking lot for pick-up.
7. That future leases require tenants to park in the parking lot if space is available.
8. All improvements shall be completed by May 30, 1987.
