A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER
SECTION 14-123.101(2) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING
TO ZONING TO PERMIT THE CONSTRUCTION OF A STAIRWAY ENCLOSURE
ON A PARKING RAMP FOR PROPERTY ZONED PUD, PLANNED UNIT
DEVELOPMENT DISTRICT LOCATED AT 300 SOUTH COUNTY ROAD 18
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Equitable Life Assurance Society of the United States has made application to
the City Council for a special permit under Section 14-123.101(2) of the St. Louis Park
Ordinance Code for the purpose of enclosing a stairway on a parking ramp within a PUD,
Planned Unit Development District located at 300 South County Road 18 for the legal
description as follows, to -wit:
Lots 1, 2 and 3, Block 8, Shelard Park
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 86 -77 -SP)) and the effect of the proposed stairway enclosure on
the health, safety and welfare of the occupants of the surrounding lands, existing and
anticipated traffic conditions, the effect on values of properties in the surrounding area,
the effect of the use on the Comprehensive Plan, and compliance with the intent of the
Zoning Ordinance.
3. The Council has determined that the stairway enclosure will not be detrimental
to the health, safety, or general welfare of the community nor will it cause serious traffic
congestion nor hazards, nor will it seriously depreciate surrounding property values, and
the proposed stairway enclosure is in harmony with the general purpose and intent of the
Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit a stairway enclosure on a parking ramp at the location
described is granted based on the findings set forth above and subject to the following
conditions:
1. The site be developed, used and maintained in accordance with Exhibit
"CCC" - Rendering Sheet P1; Exhibit "DDD" - Building Location, Sheet P3; Exhibit
"EEE" - Grading and Drainage Plan, Sheet P4; Exhibit "FFF" - Landscape Plan, Sheet
P5; Exhibit "GGG - Parking Plan, Sheet P6; Exhibit "HHH" - Lighting Plan, Sheet P7;
and Exhibit "IIF' - Elevation Plans, Sheets P8, P9, P10, P11 and P12, as approved by
Condition No. 37 of Resolution No. 6018 adopted on May 15, 1978; except as modified
by the following: (Exhibits are on file with Case No. 77 -85 -SP in the City Development
Department at the City of St. Louis Park)
a. That the site contain no more than 12,000 square feet of retail space.
b. That all improvements, including buildings, parking, landscaping, pedestrian
facilities, and other items as shown on the exhibits be completed by June 15, 1980.
2. That the enclosure/structure for the stairway on the west side of the parking ramp
be permitted -and constructed in accordance with Exhibit "JJJ" - Construction and
Elevation Plans for the stairway, having a cementitious exterior to match the office
building on the site -and permitting adjustment in the location of the windows to
account for the landing and floor locations.
