RESOLUTION NO. 86-167
A RESOLUTION RESCINDING RESOLUTION NO. 85-135 ADOPTED ON
SEPTEMBER 16, 1985, RESCINDING RESOLUTION NO. 84-192 ADOPTED
ON NOVEMBER 19, 1984, AND GRANTING SPECIAL (CONDITIONAL USE)
PERMIT UNDER SECTION 14-124.101 OF THE ST. LOUIS PARK
ORDINANCE CODE RELATING TO ZONING TO ALLOW THE
CONSTRUCTION OF A 27 -UNIT RESIDENTIAL DEVELOPMENT ON
PROPERTY LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT
DISTRICT AT 4625 MINNETONKA BOULEVARD
FINDINGS
WHEREAS, Leo Hodroff and Natchez Place Group (Alen Herman and Falstaff
Development Company) have made application to the City Council for a special permit
under Section 14-124.101 of the St. Louis Park Ordinance Code to allow the construction
of a 27 -unit residential development on property located at 4625 Minnetonka Boulevard
within a PUD, Planned Unit Development District having the following legal description:
Lots 2, 3, 4 and 5, Block 1, Oakenwald Addition to St. Louis Park (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case Nos. 84 -74 -SP, 85 -54 -SP and 86 -76 -SP) and the effect of the
proposed 27 -unit residential development on the health, safety, and welfare of the occupants
of the surrounding lands, existing and anticipated traffic conditions, the effect on values
of properties in the surrounding area and the effect of the use on the Comprehensive
Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 85-135 of the St. Louis Park City Council dated September 16, 1985 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 85-135 to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
CONCLUSION
NOW THEREFORE BE IT RESOLVED that Resolution No. 85-135 (filed as Document
No. 5034828) is hereby rescinded and replaced by this resolution which continues and
amends a special permit to the subject property for the purposes of permitting 27 -unit
residential development within the PUD, Planned Unit Development District at the location
described above based on the following conditions:
1. That the site be developed, used and maintained in accordance with Exhibit A - Site
Plan, except as modified by Exhibit A-1 which provides additional parking at the east
end of the parking lot; Exhibit B - Garage Floor Plan; and Exhibit C - Elevation
Plans, (Exhibits are on file in the City Development Department at the City of St.
Louis Park.)
2. That a 6 -foot wide pedestrian easement be granted to the City along the northerly
lot line prior to issuance of a Certificate of Occupancy but after completion of the
improvement by the owner or their successors or assigns.
3. The egress to Minnetonka Boulevard be designated and signed for egress only.
4. All parking lots and drives have concrete poured -in-place curbing extending at least
6 inches above and below grade.
5. All outdoor lighting be directed perpendicular to the ground and be no higher than
20 feet off the ground.
6. There be no outside storage of trash or trash containers.
7. That the City has no obligation to permit parking on abutting streets.
8. That the exhibits referred to in Condition No. 1 are hereby modified as follows: The
site shall be developed, used and maintained in accordance with Exhibit D - Site
Plan, except that the plan includes the option of providing the access to Minnetonka
Boulevard as shown on Exhibit Al; Exhibit E - Garage Floor Plan; and Exhibit F
- Elevation Plans; subject to the following:
a. That the proposed sign be in accordance with the requirements of the Sign
Ordinance.
b. That access to both Natchez Avenue and Minnetonka Boulevard be provided, if
possible, with the access to Minnetonka Boulevard restricted for emergency
purposes, if necessary. _
9. That all improvements including building, parking, driveways, walkways, landscaping
and other items as shown on the exhibits be completed by May 15, 1987.
