RESOLUTION NO. 86-149
A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER
SECTION 14-123.100 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING
TO ZONING TO PERMIT THE PLACEMENT OF FILL IN THE FLOODPLAIN
DISTRICT FOR PROPERTY ZONED B-2, BUSINESS DISTRICT, AND F-2,
FLOODPLAIN DISTRICT LOCATED AT 1325, 1329, 1333, AND 1337 COLORADO
AVENUE.
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Naegele Outdoor Advertising, Inc. (Holzer's Imported Car Service, Inc.) has made
application to the City Council for a special permit under Section 14-123.100 of the St.
Louis Park Ordinance Code for the purpose of placing fill in the floodplain district within a
B-2, Business District, and F-2, Floodplain District located at 1325, 1329, 1333 and 1337
Colorado Avenue for the legal description as follows, to -wit:
Lots 16, 17, 18 and 19, Block 1, John A. Johnson's Addition (Abstract)
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 86 -67 -SP) and the effect of the proposed placement of fill in the
floodplain on the health, safety and welfare of the occupants of the surrounding lands,
existing and anticipated traffic conditions, the effect on values of properties in the
surrounding area, the effect of the use on the Comprehensive Plan, and compliance with
the intent of the Zoning Ordinance.
3. The Council has determined that the placement of fill in the floodplain will not
be detrimental to the health, safety, or general welfare of the community nor will it
cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed placement of fill in the floodplain is in harmony with
the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit the placement of fill in the floodplain at the location
described is granted based on the findings set forth above and subject to the following
conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit A - Site
and Utility Plan; Exhibit B - Grading and Drainage Plan as modified to reduce the
slope of the drive area along the easterly side of the building to 5% or less; Exhibit
C - Elevations and Landscape and Lighting Plan; and Exhibit D - Floor Plan.
2. The lowest floor elevation of any structure on the site shall be at an elevation of
at least 878.0 feet NGVD.
3. No outside storage of trash or trash containers shall be permitted.
4. No outdoor area shall be used to display vehicles for sale.
5. All improvements on the property shall be completed by October 15, 1987.
6. This resolution is effective only upon receipt of written approval or concurrence of
the grading and drainage plan by the Bassett Creek Watershed District.
