HomeMy WebLinkAbout86-144 - ADMIN Resolution - City Council - 1986/09/020 • RESOLUTION NO. 86-1414 A RESOLUTION ACCEPTING LAND FOR DEDICATION OF RIGHT-OF-WAY FOR HAMPSHIRE AVENUE CUL-DE-SAC SOUTH OF HIGHWAY 7 WHEREAS, Harry Golden and Morris Golden, as a condition to vacate a portion of Hampshire Avenue, agreed to donate to the City certain property to provide right- of-way for a cul-de-sac for Hampshire Avenue; and WHEREAS, the City attorney has advised the City Council that Harry Golden and Morris Golden do, in fact,, have good title__ to the subject property, which is legally described as; That part of Lot 4 lying Northwesterly of a line running from a point in the Easterly line of siad Lot distant 367.24 feet Southeasterly from the most Northerly corner thereof to a point on the Westerly line of said Lot distant 535.8 feet Southeasterly from the most Westerly corner thereof. WHEREAS, the dedication and easement over the above described parcel is described as follows; A perpetual easement for public right-of-way purposes over and across the following described property: Lot 4, "AUDITOR'S SUBDIVISION NUMBER 348, HENNEPIN COUNTY, MINNESOTA," according to the recorded plat thereof. Said easement is described as follows: Commencing at the most northerly corner of said Lot 4; thence on an assumed bearing of South 14 degrees 20 minutes 00 seconds East, along the northeasterly line of said Lot 4, a distance of 302.00 feet, to the point of beginning of said easement; thence South 75 degrees 40 minutes 00 seconds West a distance of 20.00 feet; thence South 30 degrees 40 minutes 00 seconds West a distance of 35.35 feet; thence South 14 degrees 20 minutes 00 seconds East a distance of 55.00 feet; thence North 75 degrees 40 minutes 00 seconds East a distance of 45.00 feet, to the northeasterly line of said Lot 4; thence North 14 degrees 20 minutes 00 seconds West, along said northeasterly line, a distance of 80.00 feet to the point of beginning. WHEREAS, a deed has been presented to the City of St. Louis Park conveying the right-of-way easements to the City; .2 ..1.47 410 .7_://1; 4 6 9 -mss-%; '.it 5 g�3 P. %2e NOW THEREFORE BE IT RESOLVED, that the deed of said above described property is hereby accepted, and the City Clerk is authorized and directed to file the deed in the office of the Hennepin County Registrar of Title. Adopted by the City Council September 2, 1986 Mayor ATTEST: City Clerk Reviewed for Administration: Approved as to form and legality: City Manager City Attorney 341 ORDINANCE NO. 1693-86 AN ORDINANCE VACATING PUBLIC STREET PORTION OF HAMPSHIRE AVENUE THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. A petition in writing signed by a majority of all of the owners of all property abutting upon both sides of the street proposed to be vacated has been duly filed with the City Clerk, requesting vacation of the street, and the City Clerk has furnished a copy of said petition to the City Manager who has reported filing of same to the newspaper, the St. Louis Park Sun/Sailor, on August 4, 1986 as directed by the said notice and has conducted a public hearing upon said petition and has determined that the street is not needed for public purposes, and that it is for the best interest of the public that said street be vacated. Section 2. The following described street, as now dedicated and laid out within the corporate limits of the City of St. Louis Park, is vacated: That part of Hampshire Avenue, originally shown on the recorded plat of "Rearrangement of St. Louis Park as Central Avenue West and now to be vacated, which lies southerly of the westerly extension of the northerly line of Lot 3, "AUDITORS'S SUBDIVISION NUMBER 348, HENNEPIN COUNTY, MINNESOTA," according to the recorded plat thereof and lying northerly of the northerly line of Lot 2, Block 51 in said "Rearrangement of St. Louis Park." reserving, however, to the City of St. Louis Park any and all easements that may exist in, over, and across the described property for storm sewer, sanitary sewer, water main, and public utility purposes. Section 3. The City Clerk is instructed to record certified copies of this ordinance in the Office of the Hennepin County Register of Deeds or Registrar of Titles as the case may be. Section 4.
