LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT THE CONSTRUCTION OF A 127 -UNIT APARTMENT BUILDING FOR PROPERTY ZONED R -B, RESIDENTIAL BUSINESS DISTRICT LOCATED AT 4341-4351 PARK GLEN ROAD ° ' BE IT RESOLVED BY the City Council of the City of St. Louis Park: ,l Findings 1. Frantz Klodt and Son, Inc. has made application ,to the City Council for a special permit under Section 14-146(5) of the St. Louis Park Ordinance Code for the purpose of constructing a 127 -unit apartment building within a R -B, Residential Business District located at 4341-4351 Park Glen Road for the legal description as follows, to -wit: Lot 2, Block 1, BELTLINE BUSINESS PARK, according' to the recorded, plat thereof, and that part of Lot 3 said Block 1 described as follows: c4. - Beginning at the most southwesterly corner of said Lot 3; thence on an assumed bearing of North 20 degrees 01 minutes 20 seconds West along a southwesterly line of said Lot 3 a distance of 219.35 feet to the intersection with the south line of Park Glen Road as dedicated in said BELTLINE BUSINESS PARK; thence North 69 degrees 58 minutes 40 seconds East, along said south line 33.46 feet to a point of curvature of a nontangential curve in ,said south line; thence southeasterly, easterly and northeasterly, along the right-of-way line of said Park Glen Road, 175.81 feet, along said nontangential curve, concave to the northwest, having a' radius of,.80.00 feet and a eentral angle of 167 degrees 53 minutes 16 seconds, the chord of said curve bears North 51 degrees 24 minutes 34 seconds East; thence North 74 degrees 58 minutes '40, seconds East, not tangent to, last described curve, 91.77 feet; thence northeasterly 183.78, feet along tangential curve, concave to the south, having a radius of 1096.00 feet and a central angle of 09 degrees 36 minutes 27 seconds; thence North 84 degrees 35_ minutes 07 seconds East, tangent to last described ctI ve, ;153.39 feet; thence South 05 degrees 24 minutes 53 seconds East 136.94feet to the intersection with the south line of said Lot 3; thence Westerly 535.21 feet along the south line of said Lot 3 to 'rr ' the, point of beginning. Containing 203,333 square feet. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 86 -39 -SP) and the effect of the proposed 127 -unit apartment building on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. • 3. The Councils has determined that the proposed 127 -unit apartment building will not be detrimental to the, health, safety, or general welfare of the community nor will it cause serious- Waffle congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed 127 -unit apartment building is in harmony with the general'.3400se and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit the construction of a 127 -unit apartment building at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A - Site 4 Plan; Exhibit B - Elevation Plan; Exhibit C - Utility Plan; and 'EXhidit D := General Floor Plan; except as modified by the following: (Exhibits are on mile in the City ,Development Department at the City of St. Louis Park.) 2.
