LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT THE PLACEMENT OF FILL IN THE FLOODPLAIN FOR PROPERTY ZONED I-1, INDUSTRIAL, AND F-2, FLOOD PLAIN DISTRICT LOCATED AT 7003 WEST LAKE STREET BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Harry Golden (BTO Development Corporation) has made application to the City Council for a special permit under Section 14-123.100(2) of the St. Louis Park Ordinance Code for the purpose of placing fill in the flood plain within a 1-1, Industrial, and F-2, Floodplain Districts located at 7003 West Lake Street for the legal description as follows, to -wit: That part of Lot 4 lying Northwesterly of a line running from a point in the Easterly line of said Lot distant 567.24 feet Southeasterly from the most Northerly corner thereof to a point on the Westerly line of said Lot distant 535.8 feet Southeasterly from the most Westerly corner thereof. Auditor's Subdivision #348, Hennepn County, Minnesota (Abstract) 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 86 -49 -SP)) and the effect of the proposed placement of fill in the flood plain on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the placement of fill in the flood plain will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed placement of fill in the flood plain is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit the placement of fill in the flood plain at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A - Grading / and Drainage Plan with respect to final grading and drainage but excluding building location and other details, and subject to the following conditions: (Exhibit on file in the City Development Department at the City of St. Louis Park.) 2. The applicant and owner(s) hereby acknowledge that the subject property and abutting area are subject to a subwatershed drainage area study (MC -19) which will provide a plan for detention and storage of flood water thereby allowing fill and development of the subject property located in a F-2, flood plain district. The applicant and property owner(s) further acknowledge their agreement to execute an agreement with the City (as prepared and approved by the City attorney) to cover the cost allocated to the subject property and to post the cash amount, letter of credit, or other security as prescribed by said agreement. Failure to execute such agreement within 30 days after submission shall invalidate this special permit resulting in it being automaticeally cancelled and rescinded. Said agreement must, however, be executed prior to grading or filling on the site and prior to issuance of a building permit to construct any of the improvements described in this resolution as shown on the exhibits.
