A RESOLUTION APPROVING A NEGATIVE DECLARATION WITH RESPECT TO
THE ENVIRONMENTAL ASSESSMENT WORKSHEET FOR THE SHELARD
OFFICE TOWER PROPOSED BY EQUITABLE LIFE ASSURANCE SOCIETY
FOR PROPERTY LOCATED AT 500 COUNTY ROAD 18
WHEREAS, an Environmental Assessment Worksheet (EAW) has been prepared
for a 356,234 square foot office building with some retail use located on a 3 -acre
site in St. Louis Park on the east side of Ford Road, also known as 500 County Road
18, consistent with the Minnesota Code of Agency Rules governing review and
procedures established to implement the Minnesota Environmental Policy Act; and
WHEREAS, in the preparation and evaluation of matters in connection with the
EAW, the City has taken into account the potential the proposed project has for
significant environmental effects related to the following factors:
1. The type, extent and reversibility of environmental effects.
2. The extent to which the environmental effects are subject to mitigation by
ongoing public regulatory authority.
3. The extent to which the environmental effects can be anticipated and controlled
as a result of other governmental studies undertaken by public agencies or the
project proposer, and whether or not there is a related action of accumulative
potential effect of related or anticipated future projects; and
WHEREAS, the City, in taking into account all of the above items, has determined
that there is no potential for significant environmental impacts which are not or
cannot be mitigated by ongoing regulatory authority including, but not limited to,
activities of the City related to zoning of the property, subdivision approval and
contractual requirements, special permit approvals, and other codes applicable by
the City or by regulatory authority of other public agencies.
NOW THEREFORE BE IT RESOLVED, that the City has determined and hereby
makes a negative declaration constituting the City's written statement that the
356,234 square foot office tower does not require the preparation of an Environmental
Impact Statement.
