A RESOLUTION GRANTING SPECIAL (CONDITIONAL USE) PERMIT UNDER
SECTION 14-123.100 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING
TO ZONING TO PERMIT THE CONSTRUCTION OF A MEMBERSHIP WHOLESALE
WAREHOUSE FOR PROPERTY ZONED I-1, INDUSTRIAL, AND F-2, FLOODPLAIN
DISTRICT, LOCATED AT 3744 LOUISIANA AVENUE
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Curtis Squire, Inc. (Costco Wholesale, Inc.) has made application to the City
Council for a special permit under Section 14-123.100 of the St. Louis Park Ordinance
Code for the purpose of constructing a membership wholesale warehouse within a I-1,
Industrial District, and F-2, Floodplain District, located at 3744 Louisiana Avenue for the
legal description as follows, to -wit:
Lots 11 to 21 inclusive and Lots 34 to 38 inclusive, all in Block 162
and that part of Lot 2 lying southerly of the easterly extension of
northerly line of Lot 11 in Block 162 subject to road; Lots 1 to 14
inclusive, Block 164 including adjacent street vacation except that part
lying westerly of easterly right-of-way line of Louisiana Avenue South
as opened by City "Rearrangement of St. Louis Park" (Abstract)
2. The City Council has considered the advice and recommendation of the Planning
Commission (Case No. 86 -35 -SP)) and the effect of the proposed membership wholesale
warehouse on the health, safety and welfare of the occupants of the surrounding lands,
existing and anticipated traffic conditions, the effect on values of properties in the
surrounding area, the effect of the use on the Comprehensive Plan, and compliance with
the intent of the Zoning Ordinance.
3. The Council has determined that the membership wholesale warehouse will not
be detrimental to the health, safety, or general welfare of the community nor will it
cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed membership wholesale warehouse is in harmony with
the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit the construction of a membership wholesale warehouse at
the location described is granted based on the findings set forth above and subject to
the following conditions:
1. That the site be developed, used and maintained in accordance with Exhibit A - Site
Plan; Exhibit B - Grading, Drainage and Erosion Control Plan; Exhibit C - Landscape
Plan; Exhibit D - Elevation Plan; subject to the following conditions: (Exhibits are
on file in the City Development Department at the City of St. Louis Park.)
2.. The grading plan shall provide for a berm for flood plain protection along the westerly
lot line extending approximately 500 feet northerly from the southwest corner in
accordance with the specifications of the Public Works Department.
3. The applicant and owner hereby acknowledge that the subject property and abutting
area are subject to a subwatershed drainage area study (MC -19) which will provide
a plan for detention and storage of flood water thereby allowing fill and development
of the subject property located in a F-2, flood plain district. The applicant and
property owner further acknowledge their agreement to execute an agreement with
the City (as prepared and approved by the City attorney) to cover the cost allocated
to the subject property and to post the cash amount, letter of credit, or other security
as prescribed by said agreement. Failure to execute such agreement within 30 days
after submission shall invalidate this special permit resulting in it being automaticeally
cancelled and rescinded. Said agreement must, however, be executed prior to grading
or filling on the site and prior to issuance of a building permit to construct any of
the improvements described in this resolution as shown on the exhibits.
4. Any structure constructed on the lot shall have the lowest floor elevation at or above
elevation 183.7 City Datum or 894.0 NGVD.
5. All lighting except globe lighting shall be directed perpendicular to the ground and
standards shall not be higher than 30 feet off the ground.
6. There shall be no outdoor storage of trash, trash containers or compactors other than
as shown and screened on the the site plan.
7. All improvements, including buildingsā landscaping, parking lot and berm shall be
completed by May 15, 1987.
