RESOLUTION NO. 85-84
AUTHORIZING TAKING OF LAND
BY EMINENT DOMAIN FOR HIGHWAY PURPOSES
EXCELSIOR BOULEVARD WIDENING
CITY PROJECT 83-32
WHEREAS, the City Council has ordered preparation of a resolution authorizing
taking of land by eminent domain for roadway purposes at the location hereinafter
specified, and it appears to the Council that it is necessary that the City
acquire such lands, therefore
BE IT RESOLVED by the City Council of St. Louis Park:
1. That it is hereby determined that the taking of the parcels of land set
forth in paragraph 3 hereof is necessary for the public good in order that said
parcels shall be devoted to roadway purposes.
2. That the City shall take by right of eminent domain for roadway purposes
the lands described in paragraph 3 hereof, and the City Attorney be hereby
authorized and directed to commence proceedings in the District Court of Hennepin
County for appointment of Commissioners to determine the damages, if any,
sustained by the respective owners of the parcels affected by such taking,
as authorized by law,
and
3. That the lands above referred to are more particularly described as
so follows:
Parcels S-9 and S-10
A permanent easement for highway purposes over that part of Lot 1, Block 10,
Brookside, according to the plat thereof on file and of record in the Office
of the Register of Deeds which lies Northwesterly of the following described
line:
Beginning at a point on the West line of said Lot 1 distant 5.2 feet
South of the Northwest corner thereof; thence Northeasterly parallel
with the Northwesterly line of said Lot 1 for a distance of 143 feet;
thence deflect right 90 degrees for a distance of 1 foot; thence deflect
left 90 degrees for a distance of 20 feet and there terminating.
A temporary construction easement which shall expire October 31, 1986,
over that part which lies Southeasterly of the following described
line:
Beginning at a point on the West line of said Lot 1 distant 5.2 feet
South of the Northwest corner thereof; thence Northeasterly parallel
with the Northwesterly line of said Lot 1 for a distance of 143 feet;
thence deflect right 90 degrees for a distance of 1 foot; thence
deflect left 90 degrees for a distance of 20 feet and there terminating.
And Northwesterly of the following described line:
Beginning at a point on the West line of said Lot 1 distant 5.2 feet
South of the Northwest corner thereof; thence Northeasterly parallel
with the Northwesterly line of said Lot 1 for a distance of 137 feet
thence deflecting to right and continuing to the East line of said
Lot 1 distant 11 feet South of the Northeast corner and there terminat-
ing.
Parcel S-17
A permanent easement for highway purposes over the Northwesterly 9 feet of
the following described tract:
Lots 1 and 2, Block 5, Suburban Homes Company Addition, according to
the plat thereof on file and of record in the Office of the Register
of Deeds in and for said Hennepin County; Except: That part of said
Lot 2 lying West of a line 40 feet West of and measured at right angles
to the center line of the main line track of the Minneapolis, North-
field and _Southern Railway, as now located and constructed.
A temporary construction easement which shall expire October 31, 1986
which lies Southeasterly of the Northwesterly 9 feet and Northwesterly of
the following described line commencing on the Westerly line distant
16 feet South of the Northwest corner thence Northeasterly parallel with
the Northwest line a distance of 40 feet thence deflecting to the left
8 degrees 0 minutes a distance of 30 feet thence deflecting to the right
8 degrees thence Northeasterly parallel with the Northwesterly line to the
Easterly line and there terminating over the following described tract:
Lots 1 and 2, Block 5, Suburban Homes Company Addition, according to
the plat thereof on file and of record in the Office of the Register
of Deeds in and for said Hennepin County; Except: That part of said
Lot 2 lying West of a line 40 feet West of and measured at right angles
to the center line of the main line track of the Minneapolis, North-
field and Southern Railway, as now located and constructed.
Also a permanent easement for highway purposes over that part of the
following described tract:

A strip of land 66 feet in width over and across Government Lot 4, Section 21,
Township 117, Range 21, lying North of Excelsior Avenue and Westerly of
Block 5, Meadowbrook Addition, which lies Southeasterly of the South-
westerly extension of a line run parallel with and 10 feet Northwesterly
from the Southeasterly line of Lot 2, Block 5, Meadowbrook Addition,
according to the recorded plat thereof.
A temporary construction easement which shall expire October 31, 1986
which lies Southeasterly of a line drawn parallel to and 4.5 feet Northerly
of the following described line:
A strip of land 66 feet in width over and across Government Lot 4,
Section 21, Township 117, Range 21, lying North of Excelsior Avenue
and Westerly of Block 5, Meadowbrook Addition, which lies Southeasterly
of the Southwesterly extension of a line run parallel with and 10 feet
Northwesterly from the Southeasterly line of Lot 2, Block 5, Meadowbrook
Addition, according to the recorded plat thereof.
