HomeMy WebLinkAbout85-75 - ADMIN Resolution - City Council - 1985/05/20RESOLUTION NO. 85-75 RESOLUTION AUTHORIZING PURCHASE OF PROPERTY FOR THE EXCELSIOR BOULEVARD WIDENING PROJECT WHEREAS, the City Council of St. Louis Park has authorized and directed the City Manager to negotiate with the owners of property for the purchase of necessary Quit Claim Deeds and construction easements for the construction of the project. WHEREAS, pursuant to such negotiations, the following have indicated their desire to sell said property to the City by Quit Claim Deed for a permanent easement for highway purposes and a construction easement. NOW THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park that the City of St. Louis Park purchase at the price indicated the following described property in Hennepin County, Minnesota, to -wit: City of Minneapolis (Park Board) (Easements) S-1 $7,506 A permanent easement for highway purposes over that part of Meadowbrook Golf Course which lies Northerly of the following described "Line B"; Commencing at a point on the East line of Section 20, Township 117, Range 21 distant 289.4 feet South of the East quarter corner of Section 20 thence Northeasterly at an angle of 71 degrees 35 minutes 52 seconds with said East line for a distance of 105.35 feet; thence deflect right 180 degrees for a distance of 50 feet to the point of beginning of a line to be hereinafter referred to as "Line A" thence along a tangential curve to the right having a radius of 1041.74 feet (delta angle of 20 degrees 18 minutes 32 seconds)for a distance of 369.25 feet to the point of termination of said "Line A"; thence Westerly tangent with said curve for a distance of 160 feet; thence deflect left 90 degrees for a distance of 33 feet to the point of beginning of "Line B"; thence deflect left 90 degrees for a distance of 10 feet thence deflect right 10 degrees 5 minutes for a distance of 91.41 feet; thence deflect right 79 degrees 55 minutes for a distance of 10 feet; thence deflect left 90 degrees for a distance of 18 feet; thence deflect left 90 degrees for a distance of 10 feet; thence deflect right 90 degrees for a distance of 44 feet thence deflect left 7 degrees 30 minutes for a distance of 88.72 feet more or less to a line parallel with and 41 feet South of said "Line A"; thence Easterly along said parallel line for a distance of 250 feet and there terminating. Duggan (Easements) N-12 $4,837 A permanent easement for highway purposes over that part of the following described tracts: All that part of Government Lots 3 and 4, Section 21, Township 117, Range 21, described as follows: Beginning at a point which is the intersection of the North line of Excelsior Avenue with the West right of way line of Minneapolis, Northfield and Southern Railway; thence Southwesterly along the Northerly line of Excelsior Avenue 110 feet; thence at an angle of 90 degrees to right 138.5 feet to a point which is 170 feet from the East line of Jackson Street; thence North parallel with the East line of Jackson Street, 337.6 feet to Westerly right of way line of Minneapolis, Northfield and Southern,Railway; thence South- easterly along Westerly right of way line of said Railway, 446.5 feet to point of beginning. All that part of Government Lots 3 and 4, in Section 21, Township 117, Range 21, described as follows: Commencing at a point on the Northerly line of Excelsior Avenue which is distant 110 feet Westerly measured along said Northerly line from the intersection of the Westerly property line of Minneapolis, Northfield and Southern Railway Company with the Northerly line of Excelsior Avenue; thence Westerly along said Northerly line of Excelsior Avenue, 40 feet; thence Northerly at right angles 120 feet; thence Easterly 40 feet to a point which is 120 feet Northerly from the Northerly line of Excelsior Avenue; said 120 feet being measured at right angles to the Northerly line of Excelsior Avenue; thence Southerly 120 feet to the point of beginning. Which lies Southeasterly of the following described line: Beginning at the most Southerly corner of Lot 2, Block 5, "Meadowbrook Addition" according to the recorded plat thereof; thence Southwesterly along the prolongation of the Southeasterly line of said Block 5 for a distance of 50 feet; thence deflect right 90 degrees for a distance of 11 feet; thence deflect left 90 degrees for a distance of 52 feet; thence deflect left 52 degrees for a distance of 7.51 feet; thence deflect right 51 degrees 30 minutes for a distance of 92.37 feet; thence deflect right 66 degrees 41 minutes for a distance of 4.9 feet; thence deflect left 69 degrees 11 minutes for a distance of 100 feet and there terminating. and the Mayor and City Manager are hereby authorized to execute any and all instruments necessary to complete the purchase of said properties, and the City Manager is hereby authorized and directed to accept delivery of the deeds and pay the indicated sums from the Special Assessment Construction Fund (25-4470-964-70) to said City of Minneapolis and William F. Duggan upon delivery by the seller of a Quit Claim Deed or Construction Easement to said property accompanied by an Abstract of Title or Owner's Certificate of Title showing good and marketable title of record to said property, together with an opinion of the Law Department of the City of St. Louis Park approving the execution of the deed and the seller's abstract or certificate.
