HomeMy WebLinkAbout85-69 - ADMIN Resolution - City Council - 1985/05/20Z) -.20 _of e RESOLUTION NO. 85-69 A RESOLUTION GRANTING PERMIT UNDER SECTIONS 14-131(1) AND 14-126(5) OF THE ZONING ORDINANCE TO PERMIT THE CONSTRUCTION OF CLUSTER HOUSING ON PROPERTY LOCATED IN THE R-2, SINGLE FAMILY RESIDENCE DISTRICT, LOCATED AT 1320, 1322, 1324 and 1326 RHODE ISLAND AVENUE. BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. John J. Glynn (Dan -Bar Homes) has made application to the City Council for a special permit under Section 14-131(1) and 14-126(5) of the St. Louis Park Ordinance Code for the purpose of constructing cluster housing located at 1320, 1322, 1324 and 1326 Rhode Island Avenue for the legal description as follows, to -wit: Lots 1 and 3, Block 1, Linners Addition (Abstract) 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 84 -110 -SP) and the effect of the proposed cluster housing on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the cluster housing will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed cluster housing is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit construction of cluster housing at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan/Landscape Plan, Exhibit B - Elevation, and Exhibit C - Utilities. (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. The utility plans shall be modified to show the manhole and water shut -offs located on the right-of-way of Rhode Island Avenue. 3. All improvements shall be completed by May 15, 1986.
