HomeMy WebLinkAbout85-66 - ADMIN Resolution - City Council - 1985/05/203 RESOLUTION NO. 85-66 A RESOLUTION GRANTING PERMIT UNDER SECTION 14-124.101 OF THE ZONING ORDINANCE TO PERMIT CONSTRUCTION OF A 165 -UNIT RESIDENTIAL APARTMENT DEVELOPMENT ON PROPERTY ZONED PUD, PLANNED UNIT DEVELOPMENT LOCATED AT 7400 HIGHWAY 7. BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findin 1. Dominium Group Incorporated has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code for the purpose of constructing a 165 -unit residential apartment development located at 7400 Highway 7 for the legal description as follows, to -wit: Lots 1, 2 & 3 Auditor's Subdivision 327 including vacated street and alley Lots 1, 2, 3, and 40 to 48 inclusive, Block 316, rearrangement of St. Louis Park including vacated alley and part of Lot 6, Block 323, rearrangement of St. Louis Park. Described as commencing at the southeast corner of Lot 10, along westerly line of Lot 6 to northerly line of State then northeasterly along northerly line of said Highway t line parallel with and 40 feet westerly from easterly line 10 northerly along said parallel line to the intersection with Lot 10 extended east then west to beginning. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 85 -20 -SP) and the effect of the proposed 165 -unit residential apartment development on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the 165 -unit residential apartment development will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed 165 -unit residential apartment development is in harmony with the general purpose and intent of the Zoning 'Ordinance and the Comprehensive Plan. Conclusion The special permit to permit construction of a 165 -unit residential apartment development at the location described is granted based on the findings set forth above and subject to the following conditions: . That the site be developed, used and maintained in accordance with Exhibit A - Site Plan, Exhibit B - Landscape Plan, Exhibit C - a basement parking plan for general purposes, Exhibits E and F - Floor Plans, Exhibits G, H, and I - Elevation Plans, except as modified by City Development on April 12, 1985 and by the conditions which follow. Although Exhibit A includes a cul de sac on Walker Street, the plan also accommodates retaining Walker, without requiring an amendment to this special permit. (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. That all light be directed perpendicular to the ground (unless globe lighting) and that no standard be higher than 20 feet as measured from the ground. 3. There be no outdoor storage of trash or trash containers. 4. There be at least 400 square feet of outside, usable open space per unit. 5. That the applicant or its successors and assigns be responsible for a pedestrian way; and the applicant or successors and assigns be responsible for planting of boulevard sod, boulevard trees along the south side of Walker, east side of Pennsylvania Avenue and the south frontage road system to its connection with Walker. 6. That if the City determines a need for additional parking, the applicant or its successors and assigns shall be responsible for providing 41 additional parking spaces. 7. That all utilities be placed underground. 41 8. That all improvements including buildings, landscaping, parking, street improvements and striping be completed by October 15, 1986.
