RESOLUTION AUTHORIZING ACCEPTANCE OF PROPERTY
FOR THE IMPROVEMENT OF THE NORTH FRONTAGE ROAD
OF HIGHWAY NO. 7 CONNECTING WITH WALKER STREET
WHEREAS, the City Council has been requested to approve the site plan
for the construction of an apartment complex south of Walker Street, east of
Pennsylvania Avenue and north and east of the service drive for Highway No. 7
at 7400 Highway No. 7.
WHEREAS, pursuant to negotiations with Dominium Group, Incorporated, they
have agreed to convey to the City, the -land described in Parcel 1 by Quit
Claim Deed, together with payment in the amount of $9,400. The parcel of land
and payment is given for other land.
WHEREAS, for consideration of the aforementioned land and money, the
City of St. Louis Park agrees to convey to the Dominium Group the land
described in Parcel 2 by Quit Claim Deed.
NOW THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park
that the City of St. Louis Park exchange the parcel of land at the aforementioned
terms and conditions.
Dominium Group to convey to the City of St. Louis Park:
Parcel 1
That part of Lot 6, Block 323, Rearrangement of St. Louis Park, Hennepin
County, Minnesota, and that part of Lot 1, Auditor's Subdivision No. 327,
Hennepin County, Minnesota, described as follows:
Commencing at the Southeast corner of Lot 10, Block 323, Rearrangement
of St. Louis Park; thence South 89 degrees 56 minutes 56 seconds East
along the Easterly extension of the South line of said Lot 10, a distance
of 56.33 feet to the point of beginning of tract to be described; thence
continuing South 89 degrees 56 minutes 56 seconds East along said Easterly
extension a distance of 15.67 feet; thence Southwesterly; parallel with
the Westerly line of_said Lot 6, along a nontangential curve which is
concave to the East, central angle of 5 degrees 50 minutes 16 seconds,
radius of 544.61 feet, chord bearing of South 13 degrees 34 minutes 51
seconds West, an arc length of 55.49 feet to the intersection with the
Northeasterly extension of the Southerly line of said Lot 1, Auditor's
Subdivision No. 327 (Northerly line of State Highway No. 7); thence South
79 degrees 49 minutes 52 seconds West along the Southerly line of said
Lot 1 and its Northeasterly extension a distance -.of 84.28 feet; thence
Northeasterly 110.90 feet along a tangential curve concave to the North-
west, radius of 104.44 feet, central angle of 60 degrees 50 minutes 21
seconds, and a chord that bears North 49 degrees 24 minutes 42 seconds
East to the point of beginning.
Containing 1624 square feet.
The City of St. Louis Park to Dominium Group, Incorporated:
Parcel 2
That part of Lot 6, Block 323, Rearrangement of St. Louis Park, Hennepin
County, Minnesota, and that part of vacated Hurst Street which is described
as follows:
Commencing at the angle point on the North line of Lot 1, Auditor's
Subdivision No. 327, Hennepin County, Minnesota; thence South 56
degrees 50 minutes 56 seconds East (assumed bearing) along the
Northeasterly line of said Lot 1 a distance of 144.18 feet to the point
of beginning of the tract to be described; thence Southerly 227.58 feet
along a nontangential curve concave to the West, radius of 1145.92 feet,
central angle of 11 degrees 22 minutes 45 seconds, and a chord that bears
South 13 degrees 18 minutes 08 seconds West to the Easterly extension of
the South line of Lot 10, Block 323; thence North 89 degrees 56 minutes
56 seconds West, not tangent to last described curve, along said Easterly
extension of the South line of Lot 10 a distance of 56.33 feet to the
Westerly line of said Lot 6; thence Northeasterly along the Westerly line
of said Lot 6 and its extension Northeasterly through part of vacated Hurst
Street, along a nontangential curve which is concave to the Southeast,
central angle of 23 degrees 08 minutes 27 seconds, radius of 614.00 feet,
chord bearing of North 26 degrees 09 minutes 53 seconds East, an arc
length of 247.98 feet to the point of beginning.
Containing 9137 square feet.
BE IT FURTHER RESOLVED that the Mayor and City Manager are hereby authorized
to execute any and all instruments necessary to complete the exchange of the
said properties, and that the City Manager is hereby authorized and directed
to accept delivery of the Quit Claim Deed and payment by Dominium Group, Incorpo-
rated as to Parcel 1 and convey by Quit Claim Deed Parcel 2 upon delivery of
a Quit Claim Deed to said Parcel 1 accompanied by an Abstract of Title or
Owner's Certificate of Title showing good and marketable title of record to said
property together with an opinion of the Law Department of the City of St. Louis
Park approving the execution of the deed and the seller's abstract of title.
