HomeMy WebLinkAbout85-64 - ADMIN Resolution - City Council - 1985/05/20RESOLUTION NO. 85--64 A RESOLUTION GRANTING PERMIT UNDER SECTIONS 14-123.100(2) AND 14-17100 OF THE ZONING ORDINANCE TO PERMIT A CONTRACTORS YARD ON PROPERTY LOCATED IN THE I-1, GENERAL INDUSTRIAL DISTRICT AND F-2, FLOOD PLAIN DISTRICT AT 6850 OXFORD STREET. BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Nielsen Investment Co. has made application to the City Council for a special permit under Sections 14-123.100(2) and 14-17100 of the St. Louis Park Ordinance Code for the purpose of a contractors yard located at 6850 Oxford Street for the legal description as follows, to -wit: That part of Lot 1 except the southwesterly twenty feet, Block 1, "Allan Garrison's Addition" (Torrens Certificate No. 632254) 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 85 -8 -SP) and the effect of the proposed contractors yard on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the contractors yard will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed contractors yard is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a contractors yard at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be improved, used and maintained in accordance with Exhibit A - Site Plan, as modified by City Development on May 14, 1985, subject to the following: (Exhibits are on file in the City Development Department at the City of St. Louis Park) 2. The special permit is limited to a contractors yard. An open sales lot or other special permit uses are prohibited. 3. No more than a total of 7 of any one or combination of the following shall be permitted on the site: semi --trailers or vans, semi -trucks, tractors, trucks or truck cranes; and said vehicles, trailers or vans shall be located in the northeast corner of the site as shown on the Site Plan except the westerly space which is deleted. 4. No lights shall be more than 20 feet above the ground and all rays shall be directed perpendicular to the ground. 5. No storage, materials, stock piles or storage of equipment shall extend more than 6 feet off the ground nor shall it extend above the fence, except the semi trailers or vans, semi -trucks, tractors, trucks or truck cranes, as permitted in Condition No. 3. 6. A 6 -foot high chain link fence, including gates, with decorative panel of weave vinyl shall be constructed and maintained thereafter as shown on the site plan. 7. The setback area on Oxford Street and Louisiana Avenue shall be landscaped and maintained thereafter as shown on the exhibit modified on May 14, 1985. Said landscaping includes three spruce trees a minimum of six feet high when planted and located in the required landscaped front yard adjacent to Louisiana Avenue; retention of the existing trees clustered at the southwest corner of the property; and on Oxford—three flowering crabs at least U inches in diameter, measured 1 foot off the ground at the time of planting, two Mountain Ash at least 2} inches in diameter measured 1 foot off the ground at the time of planting, and three planting beds each consisting of at least 3 Hughes Junipers (24-36" spread, B & B) and 3 Nineback (5 gal. 24-30" in height). 8. No private signs, permanent, temporary, portable or any other type, shall be permitted in the right-of-way or setback on Oxford Street or Louisiana Avenue. 9. The driveway shall not exceed 22 feet in width and shall be constructed in accordance with City specifications. 10. All improvements including, but not limited to, fencing, landscaping and driveway improvements, shall be completed by June 15, 1985.
