A RESOLUTION RESCINDING RESOLUTION NO. 84-190 ADOPTED ON
NOVEMBER 19, 1984, RESCINDING RESOLUTION NO. 6182 ADOPTED ON
DECEMBER 4, 1978 AND GRANTING PERMIT UNDER SECTION 14-124.101 OF
y THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW
CONSTRUCTION OF AN ADDITION AT 4801 EXCELSIOR BOULEVARD
WHEREAS, Max Grossman and Idamax Corp. (Loffhagen and Son, Inc.) has made
application to the City Council for a special permit under Section 14-124.101 of the St.
Louis Park Ordinance Code to allow construction of an addition at 4801 Excelior Boulevard
within a PUD, Planned Unit Development having the following legal description:
Lots 9 and 10, Block 4, except highway, "Minikanda Vista Addition" (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case Nos. 78 -122 -SP and 84 -93 -SP) and the effect of the proposed
construction of an addition on the health, safety, and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values of
properties in the surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the. subject property pursuant to
Resolution No. 84-190 of the St. Louis Park City Council dated November 19, 1984 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 84-190, to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
NOW THEREFORE BE IT RESOLVED that Resolution No. 84-190 is hereby rescinded
and replaced by this resolution which continues and amends a special permit to the subject
property for the purposes of permitting construction of an addition within the PUD, Planned
Unit Development District at the location described above based on the following conditions:
1) That the site be developed, used and maintained in accordance with Exhibit
A, Site Plan. (Exhibit on file at the City Development Department at the City
of St. Louis Park)
2) That all exterior walls of the proposed addition be brick to match, to the
extent possible, the existing brick on the existing building, and that there be
no openings or doors facing the south.
3) That poured in place concrete curb be provided on the perimeter of the parking
lot and measure at least six inches above grade.
4) That roof drainage be designed to divert and contain all flow within the subject
property or onto public right-of-way, and building plans, suitable to the City, be
provided incorporating such provisions.
5) That all improvements, including structure, curbing and landscaping, be completed
by May 15, 1986, except that the construction of the garage element at the south
end of the building is optional and may be constructed at a later date at the
discretion of the applicant.
