HomeMy WebLinkAbout85-52 - ADMIN Resolution - City Council - 1985/04/15REPLACEMENT RESOLUTION NO. 85-52 ® A RESOLUTION RESCINDING RESOLUTION NO. 84-214 ADOPTED ON DECEMBER 17, 1984, RESCINDING RESOLUTION NO. 7443 ADOPTED ON AUGUST 1, 1983 RESCINDING RESOLUTION NO. 7266 ADOPTED ON NOVEMBER 1, 1982 AND GRANTING PERMIT UNDER SECTION 14-124 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW MODIFICATIONS TO A 120 UNIT CONDOMINIUM AT 2100-2190 RIDGE DRIVE. WHEREAS, Darrel A. Farr Development Corporation had made application to the City Council for a special permit under Section 14-124 of the St. Louis Park Ordinance Code to permit a 120 unit condominium at 2100-2190 Ridge Drive within a DDD, Diversified Development District, having the following legal description: • Lots 2 and 3, Block 1, Farr's Sunset Ridge 2nd Addition (Abstract) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 82 -65 -SP, 83 -78 -SP, and 84 -101 -SP) and the effect of the proposed modifications to a 120 units condominium on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 84-214 of the St. Louis Park City Council dated December 17, 1984 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 84-214, to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; NOW THEREFORE BE IT RESOLVED that Resolution No. 84-214 is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting modifications to a 120 unit condominium within a DDD, Diversified Development District at the location described above based on the following conditions: 1. That the site be developed, used, and maintained in accordance with Exhibit A, Site Plan, Phase 2; Exhibit B, Elevation Plan (East Elevation, West Elevation); Exhibit C, Front/Rear Elevation and Side Elevation; Exhibit, D, General First Floor Plan; Exhibit E, General Second Floor Plan; Exhibit F, General Third Floor Plan; Exhibit G, Utility Plan, all as revised by City Development on October 15, 1982. The southern portion of the site to be developed in accordance with Exhibit J - Site Plan; Exhibit K - Landscape Plan; Exhibit L - Elevations; Exhibit M - Preliminary Grading Plan; and Exhibit N - Preliminary Utility Plan. (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. That all trash be stored and contained within the garages, and there shall be no outside storage of trash containers or trash. 3. That the pedestrian way along the westerly side of the subject property and abutting properties in Sunset Ridge be constructed as contained on the original approved plan. 4. That bike storage and related storage necessary for the occupants or maintenance of the property be included in the parking garages. 5. That the emergency access lanes be an all-weather surface of asphalt or grasscrete. 6. That all curbing on the property be poured -in-place and measuring at least six inches above grade. 7. That all construction including roadway improvements, curbing, landscaping, buildings, and pathways (including the pathway along the western edge of the entire Sunset Ridge) be completed by October 15, 1985. 8. That further modifications be allowed in accordance with Exhibit H, North, East and West Elevations which allow revisions to the roof line, balcony and stairway treatment, entrances, and reduces the quantity of brick. 9. The Site Plan and Exhibits as included in Condition No. 1 are hereby modified - to permit construction of 60 garages in accordance with Exhibit I and effective only for the area so marked on said Exhibit. Said garages to be completed by October 15, 1985. 10. The Site Plan and Exhibits as included in Condition No. 1 are hereby modified to permit the southern portion of the site to be developed in accordance with Exhibit J - Site Plan; Exhibit K - Landscape Plan; Exhibit L - Elevations; Exhibit M - Preliminary Grading Plan; and Exhibit N - Preliminary Utility Plan. All development shall be completed by May 30, 1986. ATTEST: ity Cler Reviewed for administration: Adopthe City Council April 15, 1985 ted by W. ayor Approved as to form and legality: City Attorney REPLACEMENT RESOLUTION N0. 85-54 RESOLUTION ORDERING IMPROVEMENT, ORDERING PREPARATION OF PLANS, SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR IMPROVEMENT NO 85-05: SANITARY SEWER - BELT LINE BOULEVARD BE IT RESOLVED by the City Counci 1 of the City of St. Louis Park as follows: 1. Pursuant to Council direction a preliminary report has been prepared for the improvement designated in this resolution. 2. The Council being fully advised of the pertinent facts, the improvement is ordered to be constructed, in accordance with the description in the preliminary engineering report. 3. The Acting Director of Public Works shall prepare plans and specifications for the making of the improvement. 4. The clerk shall prepare and cause to be inserted in the official newspaper and in the Construction Bulletin, an advertisement for bids upon the making of the improvement under the approved plans and specifications. The advertisement shall be published as required by law, shall specify the work to be done, and shall specify the date and time at which bids will be opened by the city clerk and city manager in the Council Chambers in the City Hall. No bids will be considered unless sealed and filed with the clerk and accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to the clerk for five percent of the amount of such bid. 5. The bids shall be tabulated by the Acting Director of Public Works who shall report his tabulation and recommendation to the City Council. Adopted by the City Council May 6, 1985 Moo r Attest: - ( C'ty Clerk Reviewed for administration: 71, W,r4f'y �- — ..- Approved as to form and legality: jl,��� !�z• City Aftorney RESOLUTION # 85-55 A RESOLUTION HOLDING THE MINNESOTA DEPARTMENT OF TRANSPORTATION (MnDOT) HARMLESS AS A CONDITION OF A VARIANCE FROM MnDOT TO THE CITY FOR STREET WIDTH AND PARKING LANES ON FRANCE AVENUE SOUTH WHEREAS, the Cities of St. Louis Park, Minneapolis and Edina are involved in a joint venture to improve France Avenue South from Excelsior Boulevard to W. 49 1/2 Street; and WHEREAS, a variance from the Minnesota Department of Transportation (MnDOT) is required to permit a street width along France Avenue South of 38 feet, with two traffic lanes and one parking lane between W. 49 1/2 and W. 45th Streets and to permit a street width of 48 feet with two traffic lanes and two parking lanes between W. 45th and W. 44th Streets and to permit a street width of 36 feet and two traffic lanes and one parking lane between W. 39th Street and Excelsior Boulevard; and WHEREAS, MnDOT is willing to grant the variance for the street widths and parking lanes, but the variance is conditional upon the City holding MnDOT harmless as a result of its variance from State standards. BE IT RESOLVED by the City Council of the City of St. Louis Park as follows: 1. The City of St. Louis Park indemnifies, saves and holds harmless the State of Minnesota and all its agents and employees of and from any and all claims, demands, actions or causes of actions of any nature or character arising out of or by reason of, in any manner, the reconstruction of France Avenue from W 49 1/2 Street to W 44th in any other manner than a 62' street; the reconstruction of France Avenue from W 39th Street to Excelsior Boulevard in any other manner than as a 38' wide street in accordance with Minnesota Rules § 8820.9912 and further agrees to defend at their sole cost and expense any action or proceeding commenced for the purpose of asserting any claim of whatever character, arising as a result of the variance.
