A RESOLUTION GRANTING PERMIT UNDER SECTION 14-145 AND
SECTION 14-195 OF THE ZONING ORDINANCE AMENDING THE
GENERAL SITE PLAN FOR SHELARD PARK AND TO PERMIT
CONSTRUCTION OF AN OFFICE BUILDING ON PROPERTY ZONED R-
B, RESIDENTIAL BUSINESS, AND LOCATED AT 450 SHELARD
PARKWAY.
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. BTO Development Corporation has made application to the City Council for
a special permit under Section 14-145 and Section 14-195 of the St. Louis Park Ordinance
Code for the purpose of construction an office building located at 450 Shelard Parkway.
for the legal description as follows, to -wit:
Lot 1, Block 2, Shelard Park (Abstract)
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 85 -5 -SP) and the effect of the proposed office building on
the health, safety and welfare of the occupants of the surrounding lands, existing and
anticipated traffic conditions, the effect on values of properties in the surrounding area,
the effect of the use on the Comprehensive Plan, and compliance with the intent of the
Zoning Ordinance.
3. The Council has determined that the office building will not be detrimental
to the health, safety, or general welfare of the community nor will it cause serious traffic
congestion nor hazards, nor will it seriously depreciate surrounding property values, and
the proposed office building is in harmony with the general purpose and intent of the
Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit construction of an office building at the location described
is granted based on the findings set forth above and subject to the following conditions:
1. That the General Site Plan - Exhibit A-1, governing land use for Shelard Park
be amended to permit office use or residential use on Lot 1, Block 2 Shelard Park.
2. That the site be developed, used and maintained in accordance with Exhibit A
- Site/Landscape Plan; Exhibit B - Grading/Drainage/Utility Plan; Exhibit C
- Ground Floor, Second Floor and Third through Sixth Floor Plan; Exhibit D
- West Elevation and East Elevation; Exhibit E - North Elevation and South
Elevation; Exhibit F - Site Section 1 and Site Section 2; Exhibit G - Site Section
3 and Site Section 4.
3. That all deciduous trees be a minimum of 21 inches in diameter, measured one
foot off the ground at the time of planting
4. That a solid landscape screen mass be established and maintained in the 15'
landscape strip located on the west lot line extending from the northerly point
of said line south a distance of 360 feet. Landscaping shall consist of deciduous
and coniferous trees and shrubbery to provide a solid living mass from 2 feet off
the ground to 10 feet off the ground at the time of planting and shall be
maintained thereafter.
5. That there be no outdoor storage of trash or trash containers.
6. That all lighting be directed perpendicular to the ground and the illuminaire be
no higher than 15 feet above the grade of the parking deck.
7. That all curbing be poured in place concrete measuring at least 6 inches above
the grade.
8. That the fire protection devices be included as required by the Fire Chief and/or
Fire Marshall.
9. That signs shall conform to the adopted Sign Policy for Shelard Park.
10. That the penthouse be constructed with the same identical exterior materials or
nearly identical materials as contained on the exterior of the rest of the building.
11. That the applicant and its successors and assigns understand and hereby agree
that there is to be no onstreet parking on Shelard Parkway or the frontage roads.
12. That all improvements including building, parking, landscaping, and all other
elements as shown on the plan and exhibits be completed by October 15, 1986.
