AUTHORIZING TAKING OF LAND
BY EMINENT DOMAIN FOR HIGHWAY PURPOSES
EXCELSIOR BOULEVARD WIDENING
CITY PROJECT 83-32
WHEREAS, the City Council has ordered preparation of a resolution authorizing
taking of land by eminent domain for roadway purposes at the location hereinafter
specified-, and it appears to the Council that it is necessary that the City
acquire such lands, therefore
BE IT RESOLVED by the City Council of St. Louis Park:
1. That it is hereby determined that the taking of the parcels of land set
forth in Paragraph 3 hereof is necessary for the public good in order that said
parcels shall be devoted to roadway purposes.
2. That the City shall take by right of eminent domain for roadway purposes
the lands described in Paragraph 3 hereof, and the City Attorney be hereby
authorized and directed to commence proceedings in the District Court of Hennepin
County for appointment of Commissioners to determine the damages, if any,
sustained by the respective owners of the parcels affected by such taking, as
authorized by law,
and
3. That the lands above referred to are more particularly described as
follows:

Parcels S-9 and S-10
A permanent easement for highway purposes over that part of Lot 1, Block 10,
Brookside, according to the plat thereof on file and of record in the Office
of the Register of Deeds which lies Northwesterly of the following described
line:
Beginning at a point on the West line of said Lot 1 distant 5.2 feet
South of the Northwest corner thereof; thence Northeasterly parallel
with the Northwesterly line of said Lot 1 for a distance of 143 feet;
thence deflect right 90 degrees for a distance of 1 foot; thence deflect
left 90 degrees for a distance of 20 feet and there terminating.
A temporary construction easement which shall expire October 31, 1986,
over that part which lies Southeasterly of the following described
line:
Beginning at a point on the West line of said Lot 1 distant 5.2 feet
South of the Northwest corner thereof; thence Northeasterly parallel
with the Northwesterly line of said Lot 1 for a distance of 143 feet;
thence deflect right 90 degrees for a distance of 1 foot; thence
deflect left 90 degrees for a distance of 20 feet and there terminating.
And Northwesterly of the following described line:
Beginning at a point on the West line of said Lot 1 distant 10.5 feet
South of the Northwest corner thereof;,,thence Northeasterly parallel 12
with the Northwesterly line of said Lot 1 for a distance of 137 feet
thence deflecting to right and continuing to the East line of said
Lot 1 distant 11 feet South of the Northeast corner and there terminat-
ing.
