HomeMy WebLinkAbout85-132 - ADMIN Resolution - City Council - 1985/09/16RESOLUTION NO. 85-132 A RESOLUTION RESCINDING RESOLUTION NO. 7489 ADOPTED ON OCTOBER 17, 1984 AND ALSO RESCINDING RESOLUTION NO. 7384 ADOPTED ON MAY 16, 1983 AND GRANTING PERMIT UNDER SECTION 14-124(2) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW RETAIL, OFFICE, AND MANUFACTURING USE IN AN EXISTING BUILDING FOR PROPERTY LOCATED IN THE DDD, DIVERSIFIED DEVELOPMENT DISTIRCT AT 5320-5340 CEDAR LAKE ROAD FINDINGS WHEREAS, Darling Realty H (Lyle Berman, Gerald Shink and Sheri L. Heroux) has made application to the City Council for a special permit under Section 14-124(2) of the St. Louis Park Ordinance Code to allow retail, office, and manufacturing use at 5320- 5340 Cedar Lake Road within a DDD, Diversified Development District having the following legal description: Lot 1, Block 1, Watson's Addition (Abstract) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 83 -25 -SP, 83 -77 -SP and 85 -53 -SP) and the effect of the proposed retail, office, and manufacturing use in an existing building on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, special permits were issued regarding the subject property pursuant to Resolution No. 7489 of the St. Louis Park City Council dated October 17, 1983 and Resolution No. 7384 of the St. Louis Park City Council dated May 16, 1983 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of those special permits; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permits granted by Resolution No. 7489 and Resolution No. 7384 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution Nos. 7489 and 7384 are hereby rescinded and replaced by this resolution which continues and amends special permits to the subject property for the purposes of permitting retail, office, and manufacturing use in an existing building within the DDD, Diversified Development District District at the location described above based on the following conditions: 1. The site be developed, used and maintained in accordance with Exhibit A-1, Site Plan dated August 20, 1983; Exhibit B - Floor Plan; and Exhibit C - Elevations, except that signage shall be governed by the sign policy below. (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. Signage on the site shall be limited to a total of 400 square feet counting all signs. No individual sign surface shall exceed 200 square feet. Any sign illumination shall be either indirect or internal. 3. uses occupying the building shall conform to the parking requirements of the Zoning Ordinance. In the event sufficient parking to accommodate building tenants is not available either on site or on the adjacent land leased from the County, the owner shall, at his option, either vacate portions of the building or change the uses in such a manner as to comply with the available parking. 4. The building may be used for office, warehouse, retail, health clulb, gymnasiums, manufacturing, and any use listed in Section II -D of the DDD Guide Plan dated May 16, 1977. The uses in the building may be changed without amending the special permit but subject to the limitations of available parking. 5. All improvements on the site including parking, curbing, and landscaping as shown on the exhibits shall be completed by May 30, 1984. 6. That a beauty shop be added as a permitted use.
