TO CHANGE THE ZONING CLASSIFICATION FROM R-1, SINGLE FAMILY RESIDENCE DISTRICT TO R-4, MULTIPLE FAMILY RESIDENCE DISTRICT UNDER SECTION 14-222 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING ON PROPERTY LOCATED AT 2551- 2581 VERNON AVENUE SOUTH. BE IT RESOLVED BY THE CITY OF ST. LOUIS PARK: Findings 1. On June 13, 1985, Kenneth W. Tschida (Kendale, Inc.) filed an application seeking a zoning change from R-1, Single Family Residence District to R-4, Multiple Family Residence District at 2551-2581 Vernon Avenue South for the legal description as follows, to wit: That part of the Southwest I of the Northwest J of Section 31, Township 29, Range 24 described as follows: Beginning at a point in the West line of said Southwest I of the Northwest I distant 336.2 feet North of the Southwest corner of said Southwest i of the Northwest J; thence North along said West line of the Southwest i of the Northwest j to a point distant 518.08 feet South of the Northwest corner of said Southwest I of the Northwest 1; thence Southeasterly deflecting to the right 1220 36' 42" to an intersection with a line parallel with and 150 feet East of the West line of said Southwest J of the Northwest 1; thence South along said parallel line to its intersection with a line drawn East from the actual point of beginning and parallel with the South line of said Southwest J of the Northwest 1; thence West along last said parallel line to the actual point of beginning. 2. On June 19, 1985, the Planning Commission recommended denial of the zoning change on a 5-0 vote. 3. On July 15, 1985, a public hearing was opened; and on a 7-0 vote, the City Council deferred the matter to August 5, 1985 to allow the applicant to meet and discuss his plans with neighborhood residents. 4. On August 5, 1985 the public hearing was continued and closed; and the City i Council authorized preparation of a Resolution of Denial on a 7-0 vote. 5. Based on the testimony, evidence presented, and files and records, the City i Council makes the following findings: 1) The requested change would permit uses and density of development inconsistent and incompatible with the existing zoning uses and densities on Vernon Avenue. 2) The requested change would permit up to 5 times the traffic volume on a per acre basis than would be expected from R-1 zoning. 3) The requested change is contrary to the adopted Comprehensive Plan including Housing Policy No. 1 which states "Maintain most residential neighborhoods as primarily owner -occupied single family residential areas," and would result in use of the interior portions of a residential collector with low and some medium density development to be used by high density development. CONCLUSION The application for a change in zoning classification is denied based upon the findings set forth above and on the grounds that conditions required for approval do not exist.
