HomeMy WebLinkAbout85-103 - ADMIN Resolution - City Council - 1985/07/15RESOLUTION NO. 85-103 A RESOLUTION RESCINDING RESOLUTION NO. 85-::9 ADOPTED ON APRIL 1, 1985 AND GRANTING PERMIT UNDER SECTION 14-171(6)(z) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING; TO ZONING TO ALLOW AN OPEN STORAGE YARD FOR PROPERTY LOCATED IN THE I-1, GENERAL INDUSTRIAL AND F-2, FLOOD PLAIN DISTRICT AT 6830 OXFORD STREET. FINDINGS WHEREAS, Arthur W. Bliss and Leona E. Bliss (Construction Materials, Inc.) has made application to the City Council for a special permit under Section 14-171(6)(z) of the St. Louis Park Ordinance Code to allow an open storage yard located at 6830 Oxford Street within an I-1, Industrial and F-2, Flood Plain District District having the following legal description: Lot 2, Block 1 "Allan Garrison's Addition" (Torrens Certificate No. 575015) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case No. 85 -2 -SP and 85 -40 -SP) and the effect of the proposed open storage yard on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 85-39 of the St. Louis Park City Council dated April 1, 1985 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 85-39 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 85-39 is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting open storage yard within the I-1, Industrial and F- 2, Flood Plain District District at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan and Exhibit B - Landscape Plan. (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. The driveway shall be surfaced with bituminous or equivalent materials from Oxford Street to the fence. 3. No materials stored within the storage area shall be visible above the top of the fence. 4.. All site improvements shall be completed by May 15, 1985. 5. Exhibit B - Landscape Plan identified in Condition No. 1 is hereby superseded by Exhibit C - Landscaping Plan Comparison, and more specifically the portion of that drawing labelled, "as existing plus this proposal," and said landscaping shall be completed by October 15, 1985.
