LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW CONSTRUCTION OF A NINE STORY OFFICE BUILDING (INCLUDING 3,000 SQUARE FEET OF RETAIL); A 2,000 SQUARE FOOT CAFETERIA: AND A 8,400 SQUARE FOOT CLASS I RESTAURANT FOR PROPERTY LOCATED IN THE B-2, GENERAL BUSINESS DISTRICT, AND R-4, MULTIPLE FAMILY RESIDENC-E DISTRICT, AT 5445 WAYZATA BOULEVARD AND A THIRTY UNIT APARTMENT BUILDING AT 1400 DAKOTA AVENUE. LGuis .Park Ordinance Code to allow construction oP=a'dlne,story office building lin,4 g 31."S'square feet of retail); a 2,00{1 square foot cafeteria: and a 8,400 square foot Class I Restaurant fcir property located in the 13-2, General -Business District, and R-4, Multiple FamAy, Residence District, at 6445 Wayzata Boulevard and a thirty unit apartment building -at 1400 Dakota Avenue, having the -following legal description: I Lots 1 and 2, Block. 1, Lou Park Addition WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 81 -123 -SP, 82 -12 -SP and 84 -100 -SP) and the effect of the proposed construction of a nine story office building (including 3,000 square feet ofr retail); a 2,090, square foot cafeterlg.:land,`a- 8,,8.00, squama --foot, Class I Restaurant for property located in the B-2, General°8usuwss DisViet; i 't9 fi-4, Multiple Family, Residence District, on the health, -safety, and welfare of_ the oceupants of the surrounding lands, existing and anticipated traffic eanditiiis , the effedt -on values of properties in the surrounding area and, the effect of the 'use_ori- the CoMprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 84-219 of the St. Louis Park City Council dated December 17, 1984 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring_ the amendment of that special permit; and WffEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 84-219, to add the amendments now required, and to.consolidate all conditions applicable to the subject property in this resolution; NOW THEREFORE BE IT RESOLVED that Resolution No. 84-219 is hereby rescinded: and repleced,by-this resolution which continues and amends a special permit to the subject property :forP_the .pgrposes of permitting construction of a nine story office building Oneluding 390-6- square feet of retail); a 2,000 square foot cafeteria: and a 8,400 square. foot Class I ResAarrant for property located in the B-2, General Business District, and R- 4, Multiple Family Residence District at the location described above based on the following conditions: ti 1. That the site be developed, used, and mainXained in accordance with Ek$ribit A, Site Plan; Exhibit B, Plant ing/Lighting/,Gradirng/•Utility Plan; Exbibit C, Typical Floor Plan; and Exhibit D, Elevations, exce,pt as modified by the following. , 2. That prior to issuance of a building permit, a protec,ti•ve cqy. 'nt be placed on the property providing for the sharing of 113 parking spate, or -e- the subject property for, use by the adjacent property to the west currently occupied by Steak and Ale in accordance with previous special permit provisions. 3. That the, uses approved are limited to office with a gross floor area of 240,901 square feet and a net floor area of 169,935 square feet with up to 5,000 square feet of retail,, sales and service facilities and a Class III Rrestaurant as permitted under Section 14-142(11) and with said limitations as to size and uses as specified in said sub -section and a Class I Restaurant on property zoned B-2 containing 8,400 square feet of gross floor area, said use and approval only for a concept plan and requiring submission of a special permit for final approval according to special permit procedures. 1 11 1 4. The site shall be developed, used and maintained in accordance with Exhibit I, Site Plan; Exhibit J, Elevation Plan; Exhibit K, Floor Plan; Exhibit L, Landscaping Plan; and Exhibit M, Patio Area; as modified. b. There shall be no outside storage of trash, trash containers, refuse or other material. c.
