HomeMy WebLinkAbout84-84 - ADMIN Resolution - City Council - 1984/06/04RESOLUTION NO. 84-84 A RESOLUTION RESCINDING RESOLUTION NO. 84-02 ADOPTED ON JANUARY 9, 1984 AND GRANTING PERMIT UNDER SECTION 14-171(3) OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A MINOR AUTOMOBILE REPAIR OPERATION AT 6215-6225 CAMBRIDGE STREET WHEREAS, Jerome F. Chapman has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code to allow a minor automotive repair facility at 6215-6225 Cambridge Street within a I-1, Industrial District, having the following legal description: Beginning at the northwest corner of Block 69, Rearrangement of St. Louis Park; thence south to southwest corner thereof; thence east to southeast corner of Lot 9, Block 69, St. Louis Park; thence northwesterly to beginning including all of adjacent vacated 39th Street West and including East 1/2 of adjacent Colorado Avenue vacated and including that part of West 1/2 of Colorado Avenue vacated lying northeasterly of a line drawn from northwest corner of Block 79, Rearrangement of St. Louis Park, to southwest corner of Block 69 in said Rearrangement and incuding all of east/west alley vacated lying westerly of a line running southeasterly from northwest corner of said Block 69 to southeast corner of said Lot 9, Block 69, and lying east of west line of said Block 69, "Rearrangement of St. Louis Park" (Abstract) WHEREAS, the City Council has considered the advice and recommendation of the Planning Commission (Case Nos. 83-103 and 84-47) and the effect of the proposed a minor automotive repair facility on the health, safety, and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area and the effect of the use on the Comprehensive Plan; and WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 84-02 of the St. Louis Park City Council dated January 9, 1984 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necessary, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions of the permit granted by Resolution No. 84-02 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; NOW THEREFORE BE IT RESOLVED that Resolution No. 84-02 is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting within the I-1, Industrial District, at the location described above based on the following conditions: 1) The site shall be developed, used and maintained in accordance with Exhibit A, Site Plan as modified by the Planning Department to show the landscaping in front of the building, and Exhibit B, Floor Plan. Exhibits on file at the City of St. Louis Nark, Lity Development Department. 2) Minor automotive repair useage in the building be limited to 9,176 square feet of floor area, and subject to all of the requirements of the Ordinance including: a) All work, servicing and repair shall take place within a totally enclosed building. b) There shall be no outside storage or display of goods, equipment or trash. c) All lights on the site must be directed away from any residential property. d) No vehicle shall be stored or continuously parked on the site for more than 60 hours. el All refuse shall be stored in a totally enclosed refuse room in the principal building which shall be protected with an automatic fire suppression device. f) All building faces must meet the architectural control ordinance. 3) All uses included within the building must not have a total parking requirement in excess of the parking legally provided on the site. 4) All improvements to the site shall be completed by May 15, 1984. 5) Condition No. 2 is hereby modified to allow a total of 10,926 square feet of floor area to be used for minor automobile repair. Items a) through f), inclusive, in Condition 2 shall remain in effect. The additional square footage is located at 6217 Cambridge Avenue.
