A RESOLUTION GRANTING VARIANCE IN FRONT YARD SETBACK FROM
SECTIONS 14-104(35) AND 14-133(5) OF THE ORDINANCE CODE RELATING
TO ZONING TO PERMIT A GARAGE WITH A SETBACK OF TWO FEET
INSTEAD OF THE REQUIRED THIRTY FEET IN THE R-2, SINGLE FAMILY
RESJDENTIAL DISTRICT, AT 7704 13th LANE
BE IT RESOLED BY the City Council of St. Louis Park, Minnesota:
Findings
1. Allen Tim ers has applied for a variance from Sections 14-104(35) and
14-133(5) of the Ordina ce Code relating to zoning topermit a garage with a setback
of two feet instead of th required thirty feet for a s gle family dwelling located in the
R-2, Single Family Reside tial District, at the foil wing location, to -wit:
Lot 5\ Block 1, "Penn-Zgyta"
2. The Board of Zoning \Appeals has eviewed the application for a variance
(Case No. 84 -37 -VAR) and has remended o the City Council that the application
be granted.
3. The Council has considered effect of the proposed variance upon the
health, safety and welfare of the commu 'ty, existing and anticipated traffic conditions,
light and air, danger of fire, risk to th p lic safety, the effect on values of property
in the surrounding area, and the effect of th proposed variance upon the Comprehensive
Plan.
4. Because of conditions on t e subject pro erty and on the surrounding property,
it is possible to use the subject pr perty in such a ay that the proposed variance will
not impair an adequate supply o light and air t adjacent property, unreasonably
increase the congestion in the pu lic streets, increase he danger of fire, endanger the
public safety, unreasonably dimin sh or impair health, sa ty, comfort, morals, or in any
other respect be contrary to th intent of the Zoning Ordi nce and the Comprehensive
Plan.
5. The special cond ions applying to the structure o land in question are
peculiar to such property o immediately adjoining property and o not apply generally
to other land or structurest in the district in which such land is 11kcated.
6. The granting o`fthe application is necessary for the preservation and enjoyment
of a substantial property right of the applicant. It will not merely serve as a convenience
to the applicant but is necessary to alleviate demonstrable hardship or difficulty.

RESIDENTIAL DISTRICT, AT 7704 13th LANE
BE IT RESOLVED BY the City Council of St. Louis Park, Minnesota:
Findings
1. Arlon J. Haupert and Donna Haupert (Allen Timmers) has applied for a variance
from Sections 14-104(35) and 14-133(5) of the Ordinance Code relating to zoning to permit
a garage with a setback of two feet instead of the required thirty feet for a single
family dwelling located in the R-2, Single Family Residential District, at the following
location, to -wit:
Lot 5, Block 1, "Penn-Zayta" (Torrens Cert # 622171)
2. The Board of Zoning Appeals has reviewed the application for a variance
(Case No. 84 -37 -VAR) and has recommended to the City Council that the application
be granted.
3. The Council has considered the effect of the proposed variance upon the
health, safety and welfare of the community, existing and anticipated traffic conditions,
light and air, danger of fire, risk to the public safety, the effect on values of property
in the surrounding area, and the effect of the proposed variance upon the Comprehensive
Plan.
4. Because of conditions on the subject property and on the surrounding property,
it is possible to use the subject property in such a way that the proposed variance will
not impair an adequate supply of light and air to adjacent property, unreasonably
increase the congestion in the public streets, increase the danger of fire, endanger the
