LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT AN OFFICE, WAREHOUSE AND RETAIL FURNITURE STORE FOR PROPERTY LOCATED IN THE DDD, DIVERSIFIED DEVELOPMENT DISTRICT, AT 5101 PARKDALE DRIVE BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. US Rubber Company (Office Equipment Warehouse, Inc.) has made application to the City Council for a special permit under Section 14-124(2Xa) of the St. Louis Park Ordinance Code for the purpose of permitting an office, warehouse, and retail furniture store located at 5101 Parkdale Drive for the legal description as follows, to -wit: That part of the Southwest , of the Southwest - of Section 30, Townwhip 29, Range 24 and of the Northwest ; of the Northwest 4, Section 31, Township 29; Range 24, described as follows: Beginning at a point on the Southeasterly line of Cedar Lake Road, distant 496.84 feet Southwesterly, measured along said Southeasterly line, from its intersection with the Westerly right of way line of State Highway No. 100; Thence South 14 -21'-30" East, 298.78' feet to the actual point of beginning at the tract of land to be described; Thence North 14 -21'-30" West, 298.78 feet to the Southeasterly line of Cedar Lake Road; Thence Northeasterly along the Southeasterly line of Cedar Lake Road, 496.84 feet to the Westerly right of way line of said highway; Thence Southeasterly and Southerly along said right-of- way line to an intersection with a line drawn parallel with and 286 feet Southeasterly, measured at right angles, from the Southeasterly line of Cedar Lake Road; Thence Southwesterly along said parallel line 380 feet; Thence Southwesterly along a tangential curve to the left, with a radius of 180.99 feet, a distance of 172.47 feet; Thence Southerly along a straight line, tangent to last described curve 46.32 feet to an intersection with a curved line, convex to the East, with a radius of 467.37 feet, said curved line being drawn Southerly from the actual point of beginning and tangent to said line bearing North 14 -21'-30" West; Thence Northerly along said curve line 114.27 feet to the actual point of beginning. That part of the Southwest 14 of the Southwest 4 of Section 30, Township 29, Range 24 and of the Northwest 4 of the Northwest 1-4 of Section 31, Township 29, Range 24, described as follows: Commencing at a point in the Southeasterly line of Cedar Lake Road, distant 496.84 feet South- westerly, measured along said Southeasterly line, from its intersection with the Westerly right of way line of State Highway No. 100; Thence South 14 -21'-30" East 298.78 feet to the actual point of beginning of the tract of land to be described; Thence North 14 -21'-30" West, 298.78 feet to the Southwesterly line of said road; Thence Southwesterly along said road line 35.70 feet to Easterly line of the right-of-way of the Great Northern Railway Company as described in Right-of-way Grant dated February 17, 1959 filed June 12, 1959 as Document No. 3181103 in the office of the Register of Deeds of Hennepin County, Minnesota; Thence Southeasterly along the Easterly line of said right-of-way to the point of beginning. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 84 -36 -SP) and the effect of the proposed office, warehouse, and retail furniture store on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed office, warehouse, and retail furniture store will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed office, warehouse, and retail furniture store is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit an office, warehouse, and retail furniture store at the location described is granted based on the findings set forth above and subject to the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A, Site Plan/Floor Plan, except as modified to provide a loop circulation pattern between the aisles at the south end of the parking lot and Exhibit B, Elevation Plan. (Exhibits are on file at City Hall) 2. All trash and refuse storage shall be indoors 3. All curbing to be poured in place. Concrete curbing to extend at least six inches above the ground. 4. All construction, landscaping, curbing and other modifications as shown on the exhibits shall be completed by October 15, 1984. Adopted by the City Council May 7, 1984 ATTEST: V&1r,t4 �2-1- 0 City Clerk Reviewed for administration: Y� ;M or Approved as to form and legality: City lttcr 1� i J WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 84-60 of the St. Louis Park City Council dated May 7, 1984 which contained conditions applicable to said property; and WHEREAS, due to changed circumstances, amendments to those conditions are now necerry, requiring the amendment of that special permit; and WHEREAS, it is the intent of this resolution to continue and restate the conditions It of the permit granted by Resolution No. 84-60 to add the amendments now required, and to consolidate all conditions applicable to the subject property in this resolution; CONCLUSION NOW THEREFORE BE IT RESOLVED that Resolution No. 84-60 (filed as Document No. 4894279) is hereby rescinded and replaced by this resolution which continues and amends a special permit to the subject property for the purposes of permitting office, warehouse, retail furniture store and aerobics studio within the DDD, Diversified Development District at the location described above based on the following conditions: 1. The site shall be developed, used and maintained in accordance with Exhibit A - Site Plan/Floor Plan, except as modified to provide a loop circulation pattern between the aisles at the south end of the parking lot and Exhibit B - Elevation Plan. (Exhibits are on file in the City Development Department at the City of St. Louis Park.) 2. All trash and refuse storage shall be indoors. 3. All curbing to be poured in place, concrete curbing to extend at least six inches above and below grade. 4. All construction, landscaping, curbing and other modifications as shown on the exhibits shall be completed by October 15, 1984. 5. That an aerobics studio is hereby permitted in accordance with Exhibit A - Site Plan/Floor Plan, subject to the following: a. The landscaped island shown on the exhibit shall be installed prior to issuance of an occupancy permit for the aerobic dance/workout facility, and said landscaped island shall be consistent with the requirements of the Diversified Development District. b. The applicant is aware that on -street parking may be prohibited and the applicant may be required to construct additional parking if parking is determined inadequate by the City. d. That all improvements be completed by October 15, 1987.
