A RESOLUTION GRANTING PERMIT UNDER SECTION 14-186(5Xc) OF
THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO
PERMIT A NON -CONFORMING BILLBOARD (CONTINGENT ON REMOVAL
OF THE EXISTING BILLBOARD AT 7351 HIGHWAY 7) ON PROPERTY
LOCATED IN THE B-2, GENERAL BUSINESS DISTRICT, AT 9000
HIGHWAY 7
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Naegele Outdoor Advertising Company has made application to the City
Council for a special permit under Section 14-186(5)(c) of the St. Louis Park Ordinance
Code for the purpose of constructing a non -conforming billboard contingent on removal
of the existing billboard 7351 Highway 7 located at 9000 Highway 7 located at 9000
Highway 7 for the legal description as follows, to -wit:
That part of the Southwest Quarter of Section 18, Township
117, Range 21, Hennepin County, Minnesota, described as
beginning at the most westerly corner of Lot 3, Block 1,
Target Second Addition, according to the recorded plat
10 thereof, Hennepin County, Minnesota; thence northeasterly
along the northwesterly line of said Lot 3 a distance of
170.00 feet. thence northwesterly, deflecting to the left
90 degrees 00 minutes 00 seconds a distance of 50.00 feet;
thence southwesterly deflecting to the left 90 degrees 00
minutes 00 seconds to the south line of said Southwest
Quarter of Section 18; thence easterly along said south line
of the Southwest Quarter of Section 18 to the point of
beginning.
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 84 -18 -SP) and the effect of the proposed non -conforming
billboard on the health, safety and welfare of the occupants of the surrounding lands,
existing and anticipated traffic conditions, the effect on values of properties in the
surrounding area, the effect of the use on the Comprehensive Plan, and compliance with
the intent of the Zoning Ordinance.
3. The Council has determined that the proposed non -conforming billboard will
not be detrimental to the health, safety, or general welfare of the community nor will
it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed non -conforming billboard is in harmony with the general
purpose and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to permit construction of a billboard which is non -conforming by reason
of its distance from a residential zoning district at 9000 Highway 7 is granted subject to
the following conditions:
1. The existing billboard at 7351 Highway 7 be removed prior
to construction of the requested new billboard
2. The site be developed, used, and maintained in accordance
with Exhibit A, Site Survey
