LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A NON -CONFORMING BILLBOARD CONTINGENT ON REMOVAL OF THE EXISTING BILLBOARD ON PROPERTY LOCATED IN THE I-1, GENERAL INDUSTRIAL DISTRICT, AT 6215 WEST 36TH STREET BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Naegele Outdoor Advertising Company has made application to the City Council for a special permit under Section 14-186(5)(c) of the St. Louis Park Ordinance go Code for the purpose of constructing a non -conforming billboard contingent on removal of the existing billboard (6039 Highway 7) located at 6215 West 36th Street for the legal description as follows, to -wit: Lots 28 to 36 inclusive including adjacent 1/2 of Park Street vacated except State Highway, Block 32, "Rearrangement of St. Louis Park" Addition 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 84 -19 -SP) and the effect of the proposed non -conforming billboard on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the non -conforming billboard will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed non -conforming billboard is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. f.nnn minn The special permit for construction of a billboard which is non -conforming by reason of its distance to a residential zoniing district and is being exchange for the existing billboard at 6039 Highway 7 is granted subject to the following conditions: 1. The existing billboard at 3550 Brunswick Avenue South (and at 6039 Highway 7) be removed prior to construction of the requested new billboard. 2. The site shall be developed, used, and maintained in accordance with Exhibit A, Site Survey.
