. A RESOLUTION RESCINDING RESOLUTION NOA182 ADOPTED ON DECEMBER
4, 1978 AND GRANTING PERMIT UNDER SECTION 14-124.101 OF THE ST.
LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW
CONSTRUCTION OF AN ADDITION AT 4801 EXCELSIOR BOULEVARD
WHEREAS, Max Grossman and Idamax Corp. (Loffhagen and Son, Inc.) has made
application to the City Council for a special permit under Section 14-124.101 of the St.
Louis Park Ordinance Code to allow construction of an addition at 4801 Excelior Boulevard
within a PUD, Planned Unit Development having the following legal description:
Lots 9 and 10, Block 4, except highway, "Minikanda Vista Addition" (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case Nos. 78 -122 -SP and 84 -93 -SP) and the effect of the proposed
construction of an addition on the health, safety, and welfare of the occupants of the
surrounding lands, existing and anticipated traffic conditions, the effect on values of
properties in the surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 6182 of the St. Louis Park City Council dated December 4, 1978 which
contained conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 6182, to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
NOW THEREFORE BE IT RESOLVED that Resolution No. 6182 is hereby rescinded
and replaced by this resolution which continues and amends a special permit to the subject
property for the purposes of permitting construction of an addition within the PUD, Planned
Unit Development District at the location described above based on the following conditions:
1) That the site be developed, used and maintained in accordance with Exhibit
A, Site Plan. (Exhibit on file at the City Development Department at the City
of St. Louis Park)
2) That all exterior walls of the proposed addition be brick to match, to the
extent possible, the existing brick on the existing building, and that there be
no openings or doors facing the south.
3) That poured in place concrete curb be provided on the perimeter of the parking
lot and measure at least six inches above grade.
4) That roof drainage be designed to divert and contain all flow within the subject
property or onto public right-of-way, and building plans, suitable to the City, be
provided incorporating such provisions.
5) That all improvements, including structure, curbing and landscaping, be completed
by May 15, 1985.

A RESOLUTION RESCINDING RESOLUTION NO. 84-54 ADOPTED ON May 7,
1984 AND GRANTING PERMIT UNDER SECTION 14-156(17) OF THE ST. LOUIS
PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW MODIFICATION
OF THE APPROVED SITE PLAN FOR DELICATESSEN AND CLASS I
RESTAURANT IN THE B-2, BUSINESS DISTRICT, AT 9920 WAYZATA
BOULEVARD
WHEREAS, Restaurants No Limit, Inc. (Edward F. Christie) has made application to
the City Council for a special permit under Section 14-124.101 of the St. Louis Park
Ordinance Code to allow modification of the approved site plan for Delicatessen and Class
I Restaurant at 9920 Wayzata Boulevard within a B-2, Business District having the following
legal description:
All that part of the Southeast 1/4 of the Northeast 1/4 of Section
1, Township 117, North Range 22, West of the Fifth Principal
Meridian, described as follows:
Commencing at the Intersection of the North line of Superior
Boulevard with the West line of the Southeast 1/4 of the Northeast
1/4 of said Section 1; thence north along the West line of said
Southeast 1/4 of the Northeast 1/4 a distance of 231 feet; thence
Easterly parallel with Superior Boulevard 315.25 feet; thence south
to a point on the North Line of Superior Boulevard 315 feet
Easterly from the point of beginning; thence Westerly along the
Northerly line of said Boulevard 315 feet to beginning.
Parking lot east of building
Commencing on the north line of Superior Boulevard at a point
315 feet Easterly from West line of said SE 1/4 of NE 1/4 of
said Section 1; thence North 231 feet to a point 315.25 feet
Easterly from a point on West line of said SE 1/4 distant 231
feet North of the North line of Superior Boulevard; thence Easterly
parallel with Superior Boulevard 315.25 feet; thence South to a
point on the North line of Superior Boulevard 315 feet Easterly
of point of beginning; thence Westerly 315 feet to beginning;
LESS that portion, if any, taken for Trunk Highway No. 12.

anticipated traffic conditions, the effect on values of properties in the surrounding area
and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
Resolution No. 84-54 of the St. Louis Park City Council dated May 7, 1984 which contained
conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 84-54, to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
