HomeMy WebLinkAbout84-17 - ADMIN Resolution - City Council - 1984/02/06RESOLUTION NO. 84-17 RESOLUTION APPROVING AGREEMENT WITH THE ALMOR COMPANY WHEREAS, the City of St. Louis Park ("City") commenced eminent domain action against property owned by the Almor Company and Cardinal Insulated Glass Company (collectively referred to as "Almor"), and WHEREAS, as part of the settlement of that lawsuit, the City agreed to sell certain property to Almor and provide a permanent, irrevocable access to Almor's property, and WHEREAS, in an Agreement of Undertaking and Indemnification dated July 1, 1982, the City agreed that it would obtain for the benefit of Almor a permanent easement to cross the railroad tracks on that property, and WHEREAS, the City has obtained a railroad crossing agreement from the relevant railroad companies but such agreement does not provide a permanent, irrevocable easement to 10 cross the spur tracks, which can be obtained only by action of the Interstate Commerce Commission, and WHEREAS, the City desires to meet the terms of the settlement agreement with Almor. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Louis Park as follows: 1. The City Council of the City of St. Louis Park hereby approves the attached Agreement between the City and Almor. 2. The Mayor and City Manager are authorized to execute this Agreement and to take whatever other action is necessary to place this Agreement in full force and effect.
