HomeMy WebLinkAbout84-161 - ADMIN Resolution - City Council - 1984/10/01RESOLUTION NO. 84-161 A RESOLUTION RESCINDING RESOLUTION NO. 7366 ADOPTED APRIL 18, 1983 AND GRANTING PERMIT UNDER SECTION 14-124.101 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A 134 UNIT HOTEL WITH A CLASS III RESTAURANT IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT, AT 5355 39TH STREET WEST. WHEREAS, Frantz Klodt and Son, Inc. has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code to allow a 134 unit hotel with a Class III Restaurant at 5355 39th Street West within a PUD, Planned Unit Development District having the following legal description: That part of the Northwest Quarter of the Northwest Quarter of Section 7, Township 28, Range 24, described as commencing at the Northwest corner of said Northwest Quarter of the Northwest Quarter; thence South along the West line thereof 443.71 feet; thence East parallel with the North line of said Northwest Quarter of the Northwest Quarter a distance of 624.5 feet to the actual point of beginning; thence West along said parallel line 488.66 feet; thence South parallel with the West line of said Northwest Quarter of the Northwest Quarter a distance of 200 feet; thence East parallel with the North line of said Northwest Quarter of the Northwest Quarter a distance of 304.9 feet; thence Southerly 113 feet, more or less, to a point which is 450.33 feet Northwesterly and on a line erected per- pendicular to the center line of Excelsior Boulevard from a point on said center line distant 850.5 feet Southwesterly along said center line from the East line of said Northwest Quarter of the Northwest Quarter; thence Northeasterly parallel with said center line 193.47 feet; thence Southerly to a point which is 318.44 feet Northwesterly and on a line erected per- pendicular to the center line of Excelsior Boulevard from a point on said center line distant 713.69 feet Southwesterly along said center line from the East line of said Northwest Quarter of the Northwest Quarter; thence North to the actual point of beginning, all according to the Government Survey thereof, the boundaries of which are fixed by Judicial Landmarks set pursuant to Torrens Case No. 14938. WHEREAS, a special permit was issued regarding the subject property pursuant to Resolution No. 7366 of the St. Louis Park City Council dated April 18, 1983 which contained conditions applicable to said property, and WHEREAS, the applicant of the approved special permit did not own the property nor did the applicant purchase or obtain ownership after approval of said special permit, and WHEREAS, Reuben L. Anderson-Cherne, Inc., fee owner of the property has requested the City Council to rescind Resolution No. 7366 by removal of Memorial (Frantz Klodt and Son, Inc.) from Certificate of Title #521687, documents #1522908 (Conditional Use Permit) and #1524677 (Special Permit) were memorialized on Certificate of Title #521687, presumably by the City of St. Louis Park, running in favor of Frantz Klodt and Son, Inc., who had agreed to purchase a parcel of land from Reuben L. Anderson-Cherne, Inc., but never concluded the transaction. NOW THEREFORE BE IT RESOLVED that Resolution No. 7366 is hereby rescinded.
