LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT EIGHT MINI -WAREHOUSE BUILDINGS WITH 156,600 SQ. FT. OF GROSS FLOOR AREA FOR PROPERTY LOCATED IN THE I-1, INDUSTRIAL; R- 3, TWO FAMILY RESIDENCE AND F-2, FLOOD PLAIN DISTRICTS AT 3200-3250 FRANCE AVENUE SOUTH. BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Richard K. Pogin has made application to the City Council for a special permit under Section 14-195(2) of the St. Louis Park Ordinance Code for the purpose of constructing eight mini -warehouse buildings with a total of 156,600 square feet of gross floor area located at 3200-3250 France Avenue South. for the legal description as follows, to -wit: That part of the Southeast Quarter of the Northeast Quarter of Section 6, Township 28, Range 24, West of the 4th Principal Meridian described as follows: Commencing at the Northeast corner of the Southeast Quarter of the Northeast Quarter of said Section 6, thence on an assumed bearing of South along the East line of said Southeast Quarter of the Northeast Quarter of Section 6, a distance of 36.30 feet, thence South 70 degrees 15 minutes West a distance of 71.19 feet to a line 67.0 feet West of and parallel with the East line of said Southeast Quarter of the Northeast Quarter of Section 6, the actual point of beginning of the land to be described; thence South 70 degrees 15 minutes West a distance of 1328.92 feet to the West line of the Southeast Quarter of the Northeast Quarter of said Section 6, thence South 0 degrees 12 minutes 20 seconds East along the West line of said Southeast Quarter of the Northeast Quarter of said Section 6, a distance of 308.24 feet; thence North 70 degrees 15 minutes East a distance of 1327.75 feet to a line 67.0 feet West of and parallel with East line of said Southeast Quarter of the Northeast Quarter of said Section 6, thence North parallel with the East line of the Northeast Quarter of the Southeast Quarter of said Section 6, a distance of 308.63 feet to the point of beginning except that part of the Northeast Quarter of the Southeast Quarter of Section 6, Township 28, Range 24 which lies Northerly of a line parallel with and 40 feet Southeasterly of the following described line: beginning at a point on the South line of the Northeast Quarter of the Southwest Quarter of said Section 6, a distance of 618.28 feet East of the Southwest corner thereof; thence North 29 degrees 29 minutes 30 seconds East a distance of 1185.78 feet to the point of curve; thence continuing Northeasterly on a tangential curve to the right, with a radius of 1376.71 feet, delta angle 25 degrees 29 minutes a distance of 590.08 feet; thence continuing Northeasterly tangent to last described curve, 49.40 feet to point of curve; thence continuing Northeasterly on a tangential curve to the right, with a radius of 9622.80 feet, delta angle 14 degrees 13 minutes, a distance of 2387.35 feet; thence continuing Northeasterly tangent to last described curve to the East line of Section 6, thence continuing along said line a distance of 100 feet and there terminating. (Abstract) 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 84 -65 -SP) and the effect of the proposed mini -warehouse buildings on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed mini warehouse buildings will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it, seriously depreciate surrounding property values, and the proposed mini warehouse buildings is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit eight mini -warehouse buildings with a total of 156,500 square feet of gross floor area at the location described is granted based on the findings set forth above.
