HomeMy WebLinkAbout84-11 - ADMIN Resolution - City Council - 1984/01/16r I RESOLUTION NO. 84--11 A RESOLUTION AMENDING RESOLUTION NO. 6266 ADOPTED MAY 21, 1979 AMENDING RESOLUTION NO. 6015 GRANTING PERMIT UNDER SECTION 14-124.101 OF THE ZONING ORDINANCE TO PERMIT THE USE OF A DRIVE -UP WINDOW WITH AUXILIARY SIGNING FOR PROPERTY LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT, AT 5001 EXCELSIOR BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. B. Dalton Bookseller has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code for the purpose of permitting a drive -up window with auxiliary signing located at 5001 Excelsior Boulevard for the legal description as follows, to -wit: Commencing from the centerline of Excelsior Boulevard 901 feet northeasterly from its intersection with the centerline of Wooddale Avenue, then at right angles southeasterly 350 feet, then southwesterly 70 feet parallel with Excelsior Boulevard, then northwesterly 350 feet to the point in the centerline of Excelsior Boulevard, a distance of 70 feet from the point of beginning. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 79 -30 -SP) and the effect of the proposed drive -up facility on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed drive -up facility will not be detrimental to the health, safety or general welfare of the community nor will it cause serious traffic conqestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed drive -up facility is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a drive -up window at the location described is granted based on the findings set forth above and subject to the following conditions: 1. Parking stalls shall have a minimum dimension of 9 feet by 20 feet and not less than 27 parking spaces shall be pro- vided on the site. The parking area shall be striped. 2. The special permit will terminate on December 31, 1988. 3. The applicant agrees to participate in the extension of the plaza area/pedestrian system from Miracle Mile to the St. Louis Park Clinic which is to be located partially adjacent to the south wall of the subject building. 4. Requirements in Condition 3 related to construction of a pedestrian way are hereby deleted.
