A RESOLUTION GRANTING PERMIT UNDER SECTIONS 14-123.100(2),
14-156(18) and 14-171(3) OF THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO ZONING TO PERMIT THE PLACEMENT OF
APPROXIMATELY 1,000 CUBIC YARDS OF FILL IN A FLOODPLAIN
AND TO PERMIT A MINOR AUTOMOTIVE REPAIR FACILITY FOR
PROPERTY LOCATED IN THE 1-1, INDUSTRIAL AND F-2, FLOODPLAIN
DISTRICTS, AT 3715 OREGON AVENUE SOUTH
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Michael McNeely has made application to the City Council for a special
permit under Section 14-123.100(2), 14-156(18) and 14-171(3) of the St. Louis Park Ordinance
Code for the purpose of permitting the placement of approximately 1,000 cubic yards of
fill in a floodplain and to permit a minor automotive repair facility located at 3715 Oregon
Avenue South for the legal description as follows, to -wit:
Lots 29-39 inclusive, Block 158, Rearrangement of St. Louis Park

2. The City Council has considered the advice an(
Planning Commission (Case No. 84 -56 -SP) and the effect of thi
automotive repair facility on the health, safety and welfare
surrounding lands, existing and anticipated traffic conditions,
properties in the surrounding area, the effect of the use on the
compliance with the intent of the Zoning Ordinance.

3. The Council has determined that the proposed fill and minor automotive repair
facility will not be detrimental to the health, safety, or general welfare of the community
nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate
surrounding property values, and the proposed fill and minor automotive facility is in
harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive
Plan.
Conclusion
The special permit to permit fill and a minor automotive repair facility at the location
described is granted based on the findings set forth above and subject to the following
conditions:
1. The site shall be developed, used and maintained in accordance with Exhibit
A, Site Plan as modified to eliminate the six head -in parking stalls along
Oregon Avenue. (Exhibits on file in the City Development Department at
the City of St. Louis Park.)
2. Concerning the minor automobile repair business:
a) All work, servicing and repair shall take place within a totally
enclosed building.
b) There shall be no outside storage or display of goods, equipment or
trash.
c) All lights on the site shall be directed away from any residential
property.
d) No vehicle shall be stored or continuously parked on the site for
more than 60 hours. No inoperable vehicles shall be parked outside
the building.
e) All refuse shall be stored in a totally enclosed refuse room in the
principal building which shall be protected with an automatic fire
suppression device.
3. The applicant has the option of installing a concrete alley to City standards
or of paving the alley with blacktop as an extension of this parking lot.
If the latter option is chosen, the portion of the lot on the alley right-of-
way shall be sloped and shaped so as to direct stormwater runoff northward
to the frontage road. If the City then improves the alley' at a later date,
the applicant agrees to hold the City harmless for any disruption of the
alley.
4. A deed restriction shall be placed on both properties which ties the parking
lot to the existing building. Evidence of recording this deed restriction
will be required before a Certificate of Occupancy will be issued.
5. All improvements on the site shall be completed by October 1, 1984.
