A RESOLUTION RESCINDING RESOLUTION NO. 7419 ADOPTED ON JULY 5,
19873 AND GRANTING PERMIT UNDER SECTION 14-195 AND 14-146 OF THE
ST. LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO ALLOW A
111 UNIT APARTMENT DEVELOPMENT AT 9925-35-45 BETTY CROCKER
DRIVE
WHEREAS, Dumps, Inc. has made application to the City Council for a special permit
under Section 14-124.101 of the St. Louis Park Ordinance Code to allow a 111 unit
apartment development at 9925-35-45 Betty Crocker Drive within an R -B, Residential
Business District, having the following legal description:
Lot 2, Block 3, Shelard Park (Abstract)
WHEREAS, the City Council has considered the advice and recommendation of the
Planning Commission (Case Nos. 83 -6 -SP and 83 -102 -SP) and the effect of the proposed a
111 unit apartment development on the health, safety, and welfare of the occupants of
the surrounding lands, existing and anticipated traffic conditions, the effect on values of
properties in the surrounding area and the effect of the use on the Comprehensive Plan; and
WHEREAS, a special permit was issued regarding the subject property pursuant to
fpResolution No. 7419 of the St. Louis Park City Council dated July 5, 1983 which contained
conditions applicable to said property; and
WHEREAS, due to changed circumstances, amendments to those conditions are now
necessary, requiring the amendment of that special permit; and
WHEREAS, it is the intent of this resolution to continue and restate the conditions
of the permit granted by Resolution No. 7419 to add the amendments now required, and
to consolidate all conditions applicable to the subject property in this resolution;
NOW THEREFORE BE IT RESOLVED that Resolution No. 7419 is hereby rescinded
and replaced by this resolution which continues and amends a special permit to the subject
property for the purposes of permitting a 111 unit apartment development within the R -B,
Residential Business District, at the location described above based on the following
conditions:

1. That the site be developed, used and maintained in accordance with
Exhibit A, Site Plan; Exhibit B, Grading and Erosion Control; Exhibit
C, Utility Plan; Exhibit D, Floor Plans for Building 1, 2, and 3; Exhibit
E, South Elevation; Exhibit F, East Elevation; Exhibit G, North Elevation;
Exhibit H, West Elevation; and Exhibit I, Landscape Plan except as
modified by the conditions which follow. (Exhibits on file in the Planning
Department at City Hall)
2. That land for the 13 parking spaces be deeded or a perpetual easement
be assigned to Coach Homes I.
3. That prior to construction, approval be obtained from the Bassett Creek
Floor control Commission if required.
4. That the applicant execute any agreement, if necessary, with the City
in connection with implementation of the storm sewer system
modifications and be responsible for undertaking any correction work or
new work assignable to the subject property or abutting property which
may be the responsibility of the applicant.
5. That all signage be in accordance with the Sign Policy for Shelard Park.
6. That the hydrant locations be adjusted according to Fire Department
specifications.
7. That all improvements including buildings, roadways, parking, garages,
parking lots, amenities, landscaping, ponding and utility work be completed
by October 15, 1984.
8. That a drainage action plan be developed and brought back to the Council
for approval.
