BE IT RESOLVED by the City Council of St. Louis Park, Minnesota:
Findings
1. Lilac Way Shopping Center has applied for a variance from Section
14-187 of the Ordinance Code relating to zoning to permit parking up to three
feet from the southerly and westerly lot line adjoining Parcel 1, Minnesota
Department of Transportation Right of Way Plat No. 27-10 located in the PUD
District at the following location, to -wit:
That part of the Northwest Quarter of the Northwest Quarter,
Section 7, Township 28, Range 24, described as commencing at the
intersection of the center line of Excelsior Avenue with the

(for the purpose of this description the east line of said
Northwest Quarter of the Northwest Quarter is a line bearing
South 0 degrees 18 minutes 12 seconds East from the northeast
corner of said Northwest Quarter of the Northwest Quarter,
assuming the north line of said Northwest Quarter of the North-
west Quarter as bearing East); thence South 66 degrees 12 minutes
29 seconds West along said center line a distance of 850.50 feet;
thence North 23 degrees 47 minutes 31 seconds West a distance
of 236.00 feet to the actual point of beginning; thence South
23 degrees 47 minutes 31 seconds East a distance of 54.00 feet;
thence South 69 degrees 19 minutes 29 seconds West a distance

2. The Council has reviewed this application in the context of the
pending eminent domain litigation filed as Hennepin County District Court
File Number CD -1805 in which the City is acquiring Parcel 1, Minnesota Depart-
ment of Transportation Right of Way Plat No. 27-10 from the applicant for public
roadway purposes. The proposed variance is in the public interest by reducing
the impact of this acquisition on the applicant's remaining property and
accordingly reducing the impact on the City's financial resources.
3. The Council has considered the effect of the proposed variance upon
the health, safety and welfare of the community, existing and anticipated
traffic conditions, light and air, danger of fire, risk to the public safety,
the effect on values of property in the surrounding area and the effect of
the proposed variance upon the Comprehensive Plan.
4. Because of conditions on the subject property and on the surrounding
property, it is possible to use the subject property in such a way that the
proposed variance will not impair an adequate supply of light and air to
adjacent property, unreasonably increase the congestion in the public streets,
increase the danger of fire, endanger the public safety, unreasonably diminish
or impair health, safety, comfort, morals, or in any other respect be contrary
to the intent of the Zoning Ordinance and the Comprehensive Plan.
5. The special conditions applying to the structure or land in question
are peculiar to such property or immediately adjoining property and do not
apply generally to other land or structures in the district in which such land
is located. •
6. The granting of the application is necessary for the preservation
and enjoyment of a substantial property right of the applicant. It will not
merely serve as a convenience to the applicant, but is necessary to alleviate
demonstrable hardship or difficulty.
Conclusion
The application for a variance for the purpose designated is granted, based
upon the findings set forth above.
Adopted by the City Council November 21, 1983.
