HomeMy WebLinkAbout7511 - ADMIN Resolution - City Council - 1983/11/21November 21, 1983 8f RESOLUTION NO. 7511 RESOLUTION AUTHORIZING PURCHASE OF PROPERTY FOR WEST 36TH STREET AND HIGHWAY 100 INTERCHANGE PROJECT AT 5430 EXCELSIOR BOULEVARD WHEREAS, the City Council of St. Louis Park has authorized and directed the City Manager to negotiate with Sidney Lorber, Diane Mathews and Elaine Phillips as personal representatives of the estate of Elly Phillips and Diane Mathews individually and Elaine Phillips individually for the purchase of the fee title and construction easement to the land hereinafter described, for public uses, and WHEREAS, Sidney Lorber, Diane Mathews and Elaine Phillips as personal representatives of the estate of Elly Phillips and Diane Mathews individually and Elaine Phillips individually, pursuant to such negotiations, have indicat- ed their desire to sell said property to the City by Warranty Deed for the sum of $27,000.00 now therefore BE IT RESOLVED by the City Council of St. Louis Park that the City of St. Louis Park purchase from Sidney Lorber, Diane Mathews and Elaine Phillips as personal representatives of the estate of Elly Phillips and Diane Mathews individually and Elaine Phillips individually, the following described prop- erty in Hennepin County, Minnesota, to -wit: Fee Title to: Parcel 1, Minnesota Department of Transportation Right -of -Way Plat No. 27-10. Temporary Construction Easement to: T.E. Parcel 1, Minnesota Department of Transportation Right of Way Plat No. 27-10. and the Mayor and City Manager are hereby authorized to execute any and all instruments necessary to complete the purchase of said property and the City Manager is hereby authorized and directed to accept delivery of the deeds and to pay the sum of $27,000.00 from the Special Assessment Construction Fund (25-4470-815-70) to Sidney Lorber, Diane Mathews and Elaine Phillips as personal representatives of the estate of Elly Phillips and Diane Mathews individually and Elaine Phillips individually as the purchase price of said property upon the delivery to them of a Warranty Deed to said property accompanied by an Abstract of Title or Owner's Certificate of Title showing good and marketable title of record to said property, together with an opinion of the Law Department of the City of St. Louis Park approving the execution of the deed and the seller's abstract or certificate.
