RESOLUTION NO. 7498
RESOLUTION AUTHORIZING PURCHASE OF PROPERTY FOR
WEST 36TH STREET AND HIGHWAY 100 INTERCHANGE PROJECT
WHEREAS, the City Council of St. Louis Park has authorized and directed the
City Manager to negotiate with the owners of property for the purchase of neces-
sary fee title and construction easements for the construction of the project.
WHEREAS, pursuant to such negotiations, the following have indicated their
desire to sell said property to the City by Warranty Deed or Quit Claim Deed or
Construction Easement.
NOW THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park that the
City of St. Louis Park purchase at the price indicated the following described
property in Hennepin County, Minnesota, to -wit:
Frank and Eugenia Theros (fee title and construction easement) $210,000.
That part of Parcel 2, Minnesota Department of Transportation Right of
Way Plat No. 27-10 lying Northerly of the following described Line A.
Commencing at a point in the West line of Section 7, Township 28 North,
Range 24 West, distant 836.91 feet South of the Northwest corner thereof;
thence North 76 degrees East 65 feet to the East line of State Highway
No. 100; thence continuing North 76 degrees East 75 feet; thence North
157.45 feet; thence South 24.05 feet; thence deflecting right 80 degrees
24 minutes for 8.85 feet; thence Southeasterly at right angles 50 feet;
thence Southwesterly at right angles 87.99 feet to Easterly line of State
Highway No. 100; thence Southeasterly along said highway 52 feet to the
actual point of beginning of Line A, thence Northeasterly at right angles
to the Easterly line of said Parcel 2 and there terminating.
A temporary construction easement in and over:
That part of Section 7, Township 28 North, Range 24 West, lying Easterly of
Parcel 2, Minnesota Department of Transportation Right of Way Plat No. 27-10
and Easterly and Southerly of Line "A" described as follows: Commencing at
a point in the West line of said Section 7, distant 836.91 feet South of the
Northwest corner thereof; thence North 76 degrees East 65 feet to the East
line of State Highway No. 100; thence continuing North 76 degrees East 75
feet; thence North 157.45 feet; to the point of beginning of said Line "A" -
thence South 24.05 feet; thence deflecting right 80 degrees 24 minutes to
the Easterly line of said Parcel 2 and there terminating.
And that part of Section 7, Township 28 North, Range 24 West, lying Easter-
ly of Parcel 2, Minnesota Department of Transportation Right of Way Plat
No. 27-10 and Westerly and Northerly of Line "B". Commencing at a point
in the West line of Section 7, Township 28 North, Range 24 West, distant
836.91 feet South of the Northwest corner thereof; thence North 76 degrees
East 65 feet to the East line of State Highway No. 100; thence continuing
North 76 degrees East 75 feet; thence North 157.45 feet; thence South 24.05
feet; thence deflecting right 80 degrees 24 minutes for 8.85 feet; thence
Southeasterly at right angles 50 feet; thence Southwesterly at right angles
87.99 feet to Easterly line of State Highway No. 100; thence Southeasterly
along said highway 52 feet to the actual point of beginning of Line "B",
thence Northeasterly at right angles 132.23 feet, thence northwesterly
at right angles 120.5 feet to a line parallel with and 643.71 feet South
of the North line of said Section 7; thence West along said parallel line
31.5 feet to point of beginning of said Line "B".
Said temporary construction easement shall expire November 15, 1988.

Hoigaards (fee title and construction easement) $67,500
Parcel 7, Minnesota Department of Transportation Right of Way Plat No. 27-11.
David Bacik (fee title only) $3,100
That part of Lot 1, Block 61, "ST. LOUIS PARK", according to the recorded
plat thereof, lying easterly of a curve, concave to the east, having a radius
of 48.00 feet. Said curve begins at a point on the east line of said Lot 1,
distant 59.00 feet northwesterly from the southeast corner of said Lot 1, and
passes through a point on the south line of said Lot 1 distant 28.00 feet
westerly from the southeast corner of said Lot 1.
R&S Investment (fee title and construction easement) $3,100
That part of said Lot 6 lying westerly of the following described line:
Commencing at the northeast corner of Block 44, Rearrangement of
St. Louis Park; thence westerly 110.00 feet along the north line of said
Block 44 to the point of beginning of the line to be described; thence so itherly
at a right angle, to the southwesterly line of said Block 44 and there termin-
ating.
Certificate of Title No. 531225.
A temporary construction easement in and over, under and across that part
of Lots 6 to 11 inclusive, Block 44, Rearrangement of St. Louis Park, lying
westerly of the following described line: Commencing at the southeast corner
of said Lot 11, thence westerly along the south line of said Lot 11 to the
southwest corner of said Lot 11, said point being the point of beginning of
the line to be described; thence northerly at right angles, to a line parallel
with and 9.00 feet northeasterly from the southwesterly line of Block 44,
Rearrangement of St. Louis Park; thence northwesterly along said parallel
line to the north line of said Block 44 and there terminating.
Said temporary construction easement shall expire November 15, 1988.
and the Mayor and City Manager are hereby authorized to execute any and all instru-
ments necessary to complete the purchase of said properties, and the City Manager
is hereby authorized and directed to accept delivery of the deeds and pay the
indicated sums from the Special Assessment Construction Fund (25-4470-815-70)
to said Frank and Eugenia Theros, Walser Buick, Hoigaards, David Bacik and
R&S Investment upon delivery by the seller of a Warranty Deed or Construction
Easement to said property accompanied by an Abstract of Title or Owner's Certif-
icate of Title showing good and marketable title of record to said property,
together with an opinion of the Law Department of the City of St. Louis Park
approving the execution of the deed and the seller's abstract or certificate.
