HomeMy WebLinkAbout7496 - ADMIN Resolution - City Council - 1983/11/07RESOLUTION NO. 7496 RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR RIGHT OF WAY AT 1441 AND 1445 SOUTH HAMPSHIRE AVENUE SOUTH WHEREAS, the City Council of St. Louis Park has authorized and directed the City Manager to negotiate with Park Pointe, a Limited Partnership, Clifford W. King and John F. White to the land hereinafter described, for public uses, and WHEREAS, Park Pointe, a Limited Partnership, Clifford W. King and John F. White, pursuant to such negotiations, have indicated their desire to deed said property the City by Quit Claim Deed, NOW THEREFORE BE IT RESOLVED by the City Council of St. Louis Park that the City of St. Louis Park accept from Park Pointe, a Limited Partnership, Clifford W. King, and John F. White, the following described property in Hennepin County, Minnesota, Park _pninte_Lirnitecl Partnership. A Limited Partnersh1p That part �f Lot 6, Block 1 and the vacated portion of the cul-de-sac of Hampshire Avenue South in the plat of Lou Park Addition lying within the circumference of a 40.00 foot radius circle. The center of the circle is described as follows: Commencing at the most Westerly Southwest corner of said Lot 6, Block 1, Lou Park Addition. Being 30 feet Easterly of the center line of Hampshire Avenue thence North along a line drawn parallel to and 30 feet East of said center line a distance of 29.00 feet thence West at right angles a distance of 11.5 feet to the center of said 40.00 foot radius circle also That part of Lot 6, Block 1 and the vacated portion of the cul-de-sac of Hampshire Avenue South in the plat of Lou Park Addition lying within the circumference of a 53.00 foot radius circle. The center of the circle is described as follows: Commencing at the most Westerly Southwest corner of said Lot 6, Block 1, Lou Park Addition. Being 30 feet Easterly of the center line of Hampshire Avenue thence North along a line drawn parallel to and 30 feet East of said center line a distance of 143.00 feet thence West at right angles a distance of 7.0 feet to the center of said 53.00 foot radius circle. Clifford W. King and John F. White That part of that parcel of land in the Southwest corner of the Northeast 1/2 of the Southeast 1/4, Section 5, Township 117, Range 21, described as follows: Commencing at the Northwest corner of the Plat of Westwood Park, 2nd Addition; thence East along the North line of said Westwood Park 2nd Addition to the Northwest corner of Lot 1, Block 1, said Westwood Park 2nd Addition; thence continuing East along the North line of said Eastwood Park 2nd Addition 135 feet; thence North parallel with the West line of the East 1/2 of the Southeast 1/4 of said Section 5 a distance of 115 feet; thence West parallel with the North line of said Westwood Park 2nd Addition to the West line of the East 1/2 of the Southeast 1/4 of said Section 5; thence South along said West line 115 feet to the point of beginning, within the circumference of a 40 foot radius circle. The center of the circle is described as follows: Commencing at the most Westerly Southwest corner of said Lot 6, Block 1, Lou Park Addition. Being 30 feet Easterly of the center line of Hampshire Avenue thence North along a line drawn parallel to and 30 feet East of said center line a distance of 29.00 feet thence West at right angles a distance of 11.5 feet to the center of said 40.00 foot radius circle. and the Mayor and City Manager are hereby authorized to execute any and all instruments necessary to complete the acquisition of said property and the City Manager is hereby authorized and directed to accept delivery of the Quit Claim Deed at no cost to the City upon the delivery to them of a Quit Claim Deed to said property accompanied by an Abstract of Title or Owner's Certificate of Title showing good and marketable title of record to said property, together with an opinion of the Law Department of the City of St. Louis Park approving the execution of the deed and the seller's abstractor certificate.
