HomeMy WebLinkAbout7441 - ADMIN Resolution - City Council - 1983/08/01RESOLUTION NO. 7441 A RESOLUTION GRANTING VARIANCE FROM SECTION 6-123 OF THE ORDINANCE CODE RELATING TO DRIVEWAY WIDTHS IN EXCESS OF 22 FEET BE IT RESOLVED by the City Council of St. Louis Park, Minnesota: Findings 1. James R. Coult has applied for a variance from Section 6-123 of the Ordinance Code relating to residential driveway widths located in an R-1 Single Family Residential District at the following location, to -wit: Lot 1, Block 9, Browndale Park 2. The staff of the Engineering Department has reviewed the application for a variance and has recommended to the City Council that the application be granted. 3. Due to the condition on the subject's property and the surrounding properties, it is possible to use the subject property in such a way that the proposed variance would not impair an adequate supply of light and air to adjacent properties, unreasonably increase the congestion of the public street, increase the danger of fire, endanger the public safety, unreasonably diminish or impair health, safety, comfort, morals, or in any other respect be contrary to the intent of the City Ordinances. 4. The City Council has approved a variance request for the construction of a three car garage and appurtenant additions to the building. This driveway width variance will allow reasonable and safe access to the three car garage as proposed. 5. The granting of this application is necessary for the preservation and enjoyment of substantial property rights of the applicant. It will not merely serve as a convenience to the applicant, but is necessary to alleviate demon- strable hardship or difficulty. 6. The applicant is requesting a driveway width of 29 feet. City ordinances only allow a driveway width of 22 feet unless a variance has been approved. Conclusion The application for a variance for a 29 -foot -wide apron abutting a public street instead of the required 22 feet is granted based upon the findings set forth above.
