HomeMy WebLinkAbout7436 - ADMIN Resolution - City Council - 1983/07/18July 18, 1983 RESOLUTION NO. 7436 RESOLUTION AUTHORIZING PURCHASE OF PROPERTY FOR WEST 36TH STREET AND HIGHWAY 100 INTERCHANGE PROJECT WHEREAS, the City Council of St. Louis Park has authorized and directed the City Manager to negotiate with the owners of property for the purchase of neces- sary fee title and construction easements for the construction of the project. WHEREAS, pursuant to such negotiations, the following have indicated their desire to sell said property to the City by Warranty Deed or Quit Claim Deed or Construction Easement. NOW THEREFORE, BE IT RESOLVED by the City Council of St. Louis Park that the City of St. Louis Park purchase at the price indicated the following described property in Hennepin County, Minnesota, to -wit: Yngve and Yngve, a partnership (Fee Title) $134,000 Minnesota Department of Transportation Right of Way Plat No. 27-10, Parcel No. 3, and All that part of the following described property: That part of section 7, township 28 north, range 24 west, described as follows: Commencing at a point in the west line of said section 7, distant 836.91 feet south of the northwest corner thereof; thence north 76° east 65 feet to the easterly line of State Highway No. 100; thence continuing north 76° east 75 feet; thence north 133.4 feet to the actual point of beginning; thence continuing north on last described line 46.65 feet; thence deflect to the left in a westerly direction 99°36' for 104.73 feet, more or less, to the easterly right of way line of State Highway No. 100; thence southeasterly along said right of way line 46 feet to a point, said point being 140 feet (measured along said easterly right of way line) from a point in a line which bears north 76° east from a point in the west line of said section 7, distant 836.91 feet south of the northwest corner thereof; thence at right angles easterly 96.95 feet to the actual point of beginning; which lies easterly of the easterly line of Minnesota Department of Transportation Right of Way Plat No. 27-10, according to the recorded plat thereof, Hennepin County, Minnesota. (Construction Easement) Minnesota Department of Transportation Right of Way Plat No. 27-10, Temporary Easement, Parcel No. 5 $1,600 Minnesota Rubber Company (Fee Title and Construction Easement) $34,500 Par. 1: Lot 7, and that part of the North Half of the vacated alley adjoining Lot 7, Block 47, "St. Louis Park Centre", lying between the extensions across it of the East line of said Lot 7 and the West line of Lot 44, Block 47, "Rearrangement of St. Louis Park", Lots 8 to 11 inclusive, all in Block 47, "St. Louis Park Centre", according to the recorded plat thereof. Par. 2: Lots 25 to 39 inclusive, and that part of the North R7771 of the vacated alley adjoining Lots 25 to 39 inclusive, Block 47, "Rearrangement of St. Louis Park", which lies between the extensions across it of the West line of said Lot 39 and the Southwesterly line of Wooddale Avenue, for- merly Pleasant Avenue, Block 47, Lots 44 to 66 inclusive, and that part of the South Half of the vacated alley adjoining Lots 44 to 66 inclusive, Block 47, "Rearrangement of St. Louis Park", which lies between the extensions across it of the West line of said Lot 44 and the Southwesterly line of Wooddale Avenue, formerly Pleasant Avenue, Block 47, all in "Rearrangement of St. Louis Park", according to the recorded plat thereof. Said taking is that part of the above described property lying southeasterly, easterly and northeasterly of Line A, described as follows: Line A Commencing at the southwest corner of Lot 58, Block 47, REARRANGEMENT OF ST. LOUIS PARK; thence easterly 090 degrees 31 minutes 53 seconds, assumed azimuth from north, 19.91 feet along the south line of said Block 47 to the point of beginning of Line "A"; thence northeasterly 142.20 feet on a tangential curve concave to the north, radius 271.56 feet and central angle 30 degrees 00 minutes 12 seconds; thence northerly 015 degrees 31 minutes 41 seconds azimuth 26.39 feet; thence northwesterly 330 degrees 31 minutes 41 seconds azimuth 81.21 feet; thence northwesterly 157.07 feet on a tangential curve concave to the southwest, radius 914.93 feet and central angle 9 degrees 50 minutes 10 seconds; thence northwesterly 320 degrees 41 minutes 31 seconds azimuth 100 feet, tangent to said curve and there terminating. Together with a 15.00 foot wide temporary easement for construction pur- poses over, under and across the above described property. The souther- ly, southeasterly and northeasterly line of said easement is Line A. Said temporary easement expires 11-15-88. That part of Lots 16 and 17, Block 43, "REARRANGEMENT OF ST. LOUIS PARK", according to the recorded plat thereof, lying northeasterly of a line drawn from a point on the north line of said Lot 17 distant 2.88 feet easterly from the northwest corner of said Lot 17, to a point on the north line of said Lot 16 distant 8.89 feet southeasterly from the most northerly corner of said Lot 16. 1 1 -3- Westinghouse Electric Corporation (Fee Title and Construction $11,500 Eastement) Parcel A All that part of the Northwest Quarter of the Southwest Quarter of Section 6, Township 28, Range 24, Hennepin County, Minnesota described as follows: Beginning at the center of said Section 6; thence North along the North and South One -Quarter line of said Section 6 a distance of 366.9 feet to the intersection with the Southerly right-of-way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence Southwesterly along said Southerly right-of-way line a distance of 2022.0 feet; thence deflecting to the left 90 degrees a distance of 20 feet to the actual point of beginning of the land to be described, which point is marked by judicial landmark; thence continuing along last described line a distance of 250 feet, which point is marked by judicial landmark; thence deflecting to the right 90 degrees along a line parallel with said Southerly right-of-way line a distance of 477.35 feet, which point is marked by judicial land- mark; thence deflecting to the right 121 degrees and 35 minutes a distance of 293.54 feet more or less, to the intersection with a line being parallel with and 20 feet Southerly, measured at right angles, from said Southerly right-of-way line, which point is marked by judicial landmark; thence deflecting to the right 58 degrees and 25 minutes along last described parallel line a dis- tance of 323.63 feet to the actual point of beginning, which point is marked by judicial landmark; according to the United States Government Survey thereof. Parcel B That part of the Northwest Quarter of the Southwest Quarter (NW 1/4 SW 1/4) of Section 6, Township 28, Range 24, Hennepin County, Minnesota described as follows: Commencing at the center of said Section 6; thence North along the North and South quarter line of said Section 6, a distance of 366.9 feet to its intersection with the South- erly right=of-way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence Southwesterly along said Southerly right-of-way line, a distance of 2022.0 feet; thence Southeasterly deflecting to the left at an angle of 90 degrees, a distance of 270 feet to a point marked by a Judicial Landmark, said last described point being the actual point of beginning of the tract of land to be hereinafter described; thence Southwesterly deflecting to the right at an angle of 90 degrees, a distance of 477.35 feet to a point marked by a Judicial Landmark; thence Southerly deflecting to the left at an angle of 58 degrees and 25 min- utes, a distance of 149.50 feet; thence Northeasterly deflecting to the left at an angle 117 degrees and 21 minutes, a distance of 557.16 feet; thence Northwesterly deflecting to the left an an angle of 94 degrees and 14 minutes, a distance of 168.48 feet to the actual point of begin- ning. Said taking is that part of Parcel B lying within the circumference of a 55.00 foot radius circle. The center of said circle is described as follows: Commencing at the southwest corner of Parcel B; thence easterly along the south line of said Parcel B 50.00 feet; thence southerly at a right angle 10.00 feet to the center of said 55.00 foot radius circle. -4- Together 4- Together with a temporary easement for construction purposes over, under and across said Parcels A and B. Said temporary easement is described as follows: Beginning at the southwest corner of said Parcel B; thence northerly 197.00 feet along the west line of said Parcels A and B; thence easterly at a right angle 35.00 feet; thence southerly at a right angle 20.00 feet; thence westerly at a right angle 15.00 feet; thence southerly at a right angle to the south line of Parcel B; thence westerly along said south line to the point of beginning. Said temporary easement expires 11-15-88. John Mahlon Kersey and Lila J. Kersey, husband and wife (Fee Title) $1,080 Commencing at the northeasterly corner of said Lot 7, ` Block 74, "St. Louis Park", according to the recorded plat thereof; thence southeasterly 99.00 feet along the easterly line of said Lot 7, to the point of beginning of the line to be described; thence south- erly 75.00 feet deflecting to the right 28 degrees 00 minutes 00 seconds and there terminating. and the Mayor and City Manager are hereby authorized to execute any and all instruments necessary to complete the purchase of said properties,and the City Manager is hereby authorized and directed to accept delivery of the deeds and pay the indicated sums from the Special Assessment Construction Fund (25-4470-815-70) to said Yngve & Yngve, Reuben L. Anderson-Cherne, Inc., Minnesota Rubber, Westinghouse Electric Corporation, and John Mahlon Kersey and Lila J. Kersey upon delivery by the seller of a Warranty Deed, Quit Claim Deed, or Construction Easement to said property accompanied by an Abstract of Title or Owner's Certificate of Title showing good and marketable title of record to said property, together with an opinion of the Law Department of the City of St. Louis Park approving the execution of the deed and the seller's abstract or certificate. est• City Clerk Adopted by the City Council July 1 1983.
