SCHEURENBRAND FOR A SPECIAL PERMIT UNDER SECTION 14-156(3) OF THE ZONING ORDINANCE TO PERMIT A DOG BOARDING KENNEL FOR PROPERTY LOCATED IN THE B-2, GENERAL BUSINESS DISTRICT, AT 4415 EXCELSIOR BOULEVARD BE IT RESOLVED BY THE CITY OF ST. LOUIS PARK: Findings 1. On April 26, 1983, Roberta K. Scheurenbrand filed an application seeking a special permit to permit a dog boarding kennel for property located in the B-2, General Business District, at 4415 Excelsior Boulevard and legally described as: Lot 2 and the Southwest 26 feet of Lot 1, except Highway, Block 14, "Minikanda Vista, St. Louis Park, Minnesota" 2. On May 4, 1983, the Planning Commission met and recommended denial of the special permit on a 5-0-1 vote. 3. On June 6, 1983, the City Council held a public hearing, received testimony from the public, and discussed the application. 4. Based upon all of the testimony, evidence presented, and files and records herein, the City Council makes the following findings: a. The dog grooming studio, as it presently exists, has insufficient parking to adequately service the clientele of the establishment. This insufficient parking causes customers to park on Kipling Avenue in the residential neighborhood and walk their dogs across private residential property. In the process, the dogs urinate and defecate on the property and disturb the quietude of the neighborhood by their barking. This negative impact will be increased by the proposed use because the number of dogs serviced at the facility on a daily basis will be increased. b. The boarding of 50 dogs so close to the residential neighborhood will also significantly increase undesirable noise and odor in the neighborhood. At a minimum, this will occur as dogs are brought to the facility, but there is also a substantial likelihood that noise and odor from inside the facility will also be detectable in the residential neighborhood. Even if proper air quality equipment is installed, such equipment is likely to periodically fail. Further, as now, doors will be left open during warm to cool the interior and freshen the air allowing noise and odor to escape into the neighborhood. There is no humane way to keep all of the boarded dogs from barking. c. Therefore, the application for the requested special permit is denied based upon the findings set forth above and on the grounds that conditions required for approval do not exist.
