LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT A 30 UNIT APARTMENT CONDOMINIUM FOR PROPERTY LOCATED IN THE R-4, MULTIPLE FAMILY RESIDENCE DISTRICT, AT 4550 MINNETONKA BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Pelletier Corporation has made application to the City Council for a special permit under Section 14-141 of the St. Louis Park Ordinance Code for the purpose of constructing a 30 unit apartment condominium located at 4550 Minnetonka Boulevard for the legal description as follows, to -wit: Lot 2 and that part of Lot 1, lying south of a line and its easterly extension drawn parallel with and distant seven feet north from the north line of Lot 2 and east of the northerly extension of the west line of said Lot 2, all in Block 2, Daystar Addition. (Torrens) 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 83 -33 -SP) and the effect of the proposed 30 unit apartment condominium on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed 30 unit apartment condominium will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed 30 unit apartment condominium is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. Conclusion The special permit to permit a 30 unit apartment condominium at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used, and maintained in accordance with Exhibit 1, Site/Grading Plan; Exhibit 2, Landscape Plan; Exhibit 3, Garage/Entry Floor Plan with respect to parking and general location for trash, lobby and party room; Exhibit 4, Typical Floor Plan for general layout; Exhibit 5, North Elevation; Exhibit 6, East Elevation; Exhibit 7, West Elevation; and Exhibit 8, South Elevation. (Exhibits on file at City Hall) 2. That an easement be provided for sidewalk usage along the south side of the property upon completion of the sidewalk and prior, to issuance of a Certificate of Occupancy. 3. That easements, rights, and/or a fire lane be established along the east side of the building or the building be sprinklered according to 13D residential standards. 4. That all concrete curbing be poured in place. 5. That the maximum ground floor area ratio and floor area ratio not exceed Ordinance requirements taking into account bonus and deduction for inside recreational space and permitting minor adjustments to the building floor plans to meet Ordinance requirements. 6. That all improvements including the buildings, parking, paving, sidewalk, berming, landscaping and other features as contained on the exhibits be completed by May 15, 1984.
