HomeMy WebLinkAbout7392 - ADMIN Resolution - City Council - 1983/06/06r RESOLUTION N0, 7392 AUTHORIZING TAKING OF LAND BY EMINENT DOMAIN FOR ROADWAY PURPOSES 36TH STREET AND STATE HIGHWAY NO. 100 INTERCHANGE PROJECT WHEREAS, the City Council has ordered preparation of a resolution authorizing taking of land by eminent domain for roadway purposes at the location hereinafter specified, and it appears to the Council that it is necessary that the City acquire such lands, therefore BE IT RESOLVED by the City Council of St. Louis Park: 1. That it is hereby determined that the taking of the parcels of land set forth in paragraph 3 hereof is necessary for the public good in order that said parcels shall be devoted to roadway purposes. 2. That the City shall take by right of eminent domain for roadway purposes the lands described in paragraph 3 hereof, and the City Attorney be hereby author- ized and directed to commence proceedings in the District Court of Hennepin County for appointment of Commissioners to determine the damages, if any, sustained by the respective owners of the parcels affected by such taking, as authorized by law, and 3. That the lands above referred to are more particularly described as follows: Minnesota Department of Transportation Right of Way Plat No. 27-10 Parcels 1, 2, 3, 5 and 6 27-10-2 That part of the following described property: Commencing at a point 135.84 feet East from the West line, and 643.71 feet South from the North line of the Northwest 1/4 of Section 7, Township 28, Range 24, Hennepin County, Minnesota; thence South 24.05 feet; thence deflecting to the right 80 degrees 24 minutes 8.85 feet; thence Southeasterly at right angles 50.00 feet; thence Southwesterly at right angles 87.99 feet to the Easterly line of Highway #100; thence Southeasterly along said highway line 52.00 feet; thence Northeasterly at right angles 132.23 feet; thence Northerly at right angles 120.50 feet; thence West 31.50 feet to the point of beginning. which lies Easterly of the Easterly line of Minnesota Department of Transpor- tation Right of Way Plat No. 27-10, according to the recorded plat thereof, Hennepin County, Minnesota. 27-10-2 That part of the following described property: Commencing at a point 135.84 feet East from the West line, and 643.71 feet South from the North line of the Northwest 1/4 of Section 7, Township 28, Range 24, Hennepin County, Minnesota; thence South 24.05 feet; thence deflect- ing to the right 80 degrees 24 minutes 8.85 feet to the actual point of begin- ning; thence Southeasterly at right angles 50.00 feet; thence Southwesterly at right angles 87.99 feet to the Easterly line of Highway #100; thence Northerly along said highway line 50.00 feet; thence Northeasterly to the point of beginning. which lies Easterly of the Easterly line of Minnesota Department of Transpor- tation Right of Way Plat No. 27-10, according to the recorded plat thereof, Hennepin County, Minnesota. h i 27-10-3 All that part of the following described property: That part of section 7, township 28 north, range 24 west, described as follows: Commencing at a point in the west line of said section 7, distant 836.91 feet south of the northwest corner thereof; thence north 760 east 65 feet to the easterly line of State Highway No. 100; thence continuing north 76° east 75 feet; thence north 133.4 feet to the actual point of beginning; thence continu- ing north on last described line 46.65 feet; thence deflect to the left in a westerly direction 99° 36' for 104.73 feet, more or less, to the easterly right of way line of State Highway No. 100; thence southeasterly along said right of way line 46 feet to a point, said point being 140 feet (measured along°said easterly right of way line) from a point in a line which bears north 76 east from a point in the west line of said section 7, distant 836.91 feet south of the northwest corner thereof; thence at right angles easterly 96.95 feet to the actual point of beginning; which lies easterly of the easterly line of Minnesota Department of Transpor- tation Right of Way Plat No. 27-10, according to the recorded plat thereof, Hennepin County, Minnesota. Said curve begins at a point on the east line of said Lot 1, distant 59.00 feet northwesterly from the southeast corner of said Lot 1, and passes through a point on the south line of said Lot 1 distant 28.00 feet westerly from the southeast corner of said Lot 1. LOUIS PARK: thence easterly 090 degrees 31 minutes 53 seconds, assumed azimuth from north, 19.91 feet along the south line of said Block 47 to the point of beginning of Line "A"; thence northeasterly 142.20 feet on a tangential curve concave to the north, radius 271.56 feet and central angle 30 degrees 00 minutes 12 seconds; thence northerly 015 degrees 31 minutes 41 seconds azimuth 26.39 feet; thence northwesterly 330 degrees 31 minutes 41 seconds azimuth 81.21 feet; thence northwesterly 157.07 feet on a tangential curve concave to the southwest, radius 914.93 feet and central angle 9 degrees 50 minutes 10 seconds; thence northwesterly 320 degrees 41 minutes 31 seconds azimuth 100 feet, tangent to said curve and there terminating. Together with a 15.00 foot wide temporary easement for construction pur- poses over, under and across the above described property. The southerly, southeasterly and northeasterly line of said easement is Line A. Said temporary easement expires 11-15-88. Parcel 3A That part of Lots 16 and 17, Block 43, "REARRANGEMENT OF ST. LOUIS PARK," according to the recorded plat thereof, lying northeasterly of a line drawn from a point on the north line of said Lot 17 distant 2.88 feet easterly from the northwest corner of said Lot 17, to a point on the north line of said Lot 16 distant 8.89 feet southeasterly from the most northerly corner of said Lot 16. Parcel 4A A temporary easement for construction purposes over, under, and across that part of Lots 1 and 2, Block 7, "Collins Second Addition to St. Louis Park," according to the recorded plat thereof, and that part of vacated 37th Street and vacated Yosemite Avenue, all described as follows: Beginning at the northwest corner of said Lot 1; thence northerly 45.00 feet along the northerly extension of the westerly line of said Lot 1; thence easterly at a right angle 35.00 feet; thence southerly at a right angle 75.00 feet; thence westerly at a right angle 55.00 feet; thence northerly at a right angle 30 feet to the westerly extension of the northerly line of said Lot 1; thence easterly along said extension to the point of beginning. Said temporary easement expires 11-15-88. Said taking is that part of said Lot 6 lying westerly of the following described line: Commencing at the northeast corner of Block 44, Rearrangement of St. Louis Park; thence westerly 110.00 feet along the north line of said Block 44 to the point of beginning of the line to be described; thence southerly at a right angle, to the southwesterly line of said Block 44 and there terminating. Together with a temporary easement for construction purposes over, under and across that part of the above described property lying westerly of the following described line: Commencing at the southeast corner of said Lot 11; thence westerly along the south line of said Lot 11 to the southwest corner of said Lot 11, said point being the point of beginning of the line to be described; thence northerly at right angles, to a line parallel with and 9.00 feet northeasterly from the southwesterly line of Block 44, Rearrange- ment of St. Louis Park; thence northwesterly along said parallel line to the north line of said Block 44 and there terminating. Said temporary easement expires 11-15-88. Parcel 7 The following described property: Parcel A All that part of the Northwest Quarter of the Southwest Quarter of Section 6, Township 28, Range 24, Hennepin County, Minnesota described as follows: Beginning at the center of said Section 6; thence North along the North and South One -Quarter line of said Section 6 a distance of 366.9 feet to the intersection with the Southerly right-of-way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence Southwesterly along said Southerly right-of-way line a distance of 2022.0 feet; thence deflecting to the left 90 degrees a distance of 20 feet to the actual point of beginning of the land to be described, which point is marked by judicial landmark; thence continuing along last described line a distance of 250 feet, which point is marked by judicial landmark; thence deflecting to the right 90 degrees along a line parallel with said Southerly right-of-way line a distance of 477.35 feet, which point is marked by judicial landmark; thence deflecting to the right 121 degrees and 35 minutes a distance of 293.54 feet more or less, to the intersection with a line being parallel with and 20 feet Southerly, measured at right angles, from said Southerly right-of-way line, which point is marked by judicial landmark; thence deflecting to r i the right 58 degrees and 25 minutes along last described parallel line a distance of 323.63 feet to the actual point of beginning, which point is marked by judicial landmark; according to the United States Government Survey thereof. Parcel B That part of the Northwest Quarter of the Southwest Quarter (NW' Sim) of Section 6, Township 28, Range 24, Hennepin County, Minnesota described as follows: Commencing at the center of said Section 6; thence North along the North and South quarter line of said Section 6, a distance of 366.9 feet to its intersection with the Southerly right- of-way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad; thence Southwesterly along siad Southerly right-of-way line, a distance of 2022.0 feet; thence Southeasterly deflecting to the left at an angle of 90 degrees, a distance of 270 feet to a point marked by a Judicial Landmark, said last described point being the actual point of beginning of the tract of land to be hereinafter described; thence Southwesterly deflecting to the right at an angle of 90 degrees, a distance of 477.35 feet to a point marked by a Judicial Landmark; thence Southerly deflecting to the left at an angle of 58 degrees and 25 minutes, a distance of 149.50 feet; thence Northeasterly deflecting to the left at an angle 117 degrees and 21 minutes, a distance of 557.16 feet; thence Northwesterly deflecting to the left at an angle of 94 degrees and 14 minutes, a distance of 168.48 feet to the actual point of beginning. Said taking is that part of Parcel B lying within the circumference of a 55.00 foot radius circle. The center of said circle is described as follows: Commencing at the southwest corner of Parcel B; thence easterly along the south line of said Parcel B 50.00 feet; thence southerly at a right angle 10.00 feet to the center of said 55.00 foot radius circle. Together with a temporary easement for construction purposes over, under and across said Parcels A and B.
