LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT CONSTRUCTION OF A SPORTS AND HEALTH CLUB FOR PROPERTY LOCATED IN THE PUD, PLANNED UNIT DEVELOPMENT DISTRICT, AT 4900 EXCELSIOR BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Peaceful Family Partnership has made application to the City Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance Code for the purpose of constructing a sports and health club located at 4900 Excelsior Boulevard for the legal description as follows, to -wit: Commencing at a point in the center line of Excelsior Avenue distant 313.25 feet Northeasterly from its intersection with the Westerly line of the Northeast quarter of the Northwest quarter of Section 7, Township 28, Range 24, Hennepin County, Minnesota; thence Northwesterly at right angles from the center line of said Excelsior Avenue a distance of 310.0 feet; thence Northeasterly along a line parallel to said center line to the most Westerly corner of Registered Survey No. 832; thence Southeasterly along the Westerly line of said Registered land Survey and its extension Southeasterly to the center line of Excelsior Avenue; thence Southwesterly along said center line to the place of beginning; all in said Section 7, Township 28, Range 24, Hennepin County, Minnesota. 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 83 -7 -SP) and the effect of the proposed sports and health club on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect, on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed sports and health club will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed sports and health club is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. ' Conclusion The special permit to permit construction of a sports and health club at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used, and maintained in accordance with the following exhibits: Exhibit A, Site Plan; Exhibit B, Lower Level Plan; Exhibit C, Entry Level Plan; Exhibit D, Track Level Plan; Exhibit E, West and South Elevation as modified to meet the architectural control provisions; Exhibit F, East and North Elevations; Exhibit G, Landscape Plan; Exhibit H, Site Lighting; and Exhibit I, Site Drainage/Utilities except as modified by the conditions which follow. Exhibits B, C, and D are for purposes of showing the use of space and not exact wall locations 2. That the curb cuts and driveway be done according to City specifications including encasement of street lighting, conduit, curb drop at driveways, and sidewalks across the driveways with no more than a 2% grade in any direction. 3. That all outdoor lights be directed perpendicular to the ground and be on poles no more than 25 feet high except on the parking deck where the height above the deck surface shall be no more than 20 feet. 4. That the truck loading area be identified on the plans and on the site. 5. That no rooftop equipment extend above the height of the parapet walls on the same level. 6. That a water augmentation system for the landscape area be provided on the north, south, and west sides of the building. 7. That all improvements including building, parking, landscaping, pedestrian ways, plaza lighting, street furniture, and all other improvements as shown on the exhibits, as hereby modified, be completed by May 15, 1984.
