RESOLUTION OF THE ST. LOUIS PARK CITY COUNCIL
WITHDRAWING A REQUEST FOR A PUBLIC HEARING BEFORE THE
MINNESOTA DEPARTMENT OF NATURAL RESOURCES ON THE
MINNEHAHA CREEK HEADWATERS CONTROL STRUCTURE MANAGEMENT POLICY
WHEREAS, on August 16, 1982, a staff report was submitted to the St. Louis
Park City Council analyzing the proposed revised Minnehaha Creek Watershed District
Management Policy for the Minnehaha Creek Headwaters Control Structure; and
WHEREAS, City staff recommended that a higher base flow rate should be in
effect on Minnehaha Creek with a minimum seasonal flow of 15 c.f.s.; and
WHEREAS, the City Council submitted this input to the Watershed District on
September 5, 1982; and
WHEREAS, the final draft of the Headwaters Control Structure Management
Policy contained a statement that recommends the base flow to be set at 12 c.f.s.
under average conditions; and
WHEREAS, on February 7, 1983, the City Council adopted Resolution No. 7333
requesting that a public hearing be established regarding said Management Policy;
and
WHEREAS, issues raised in Resolution No. 7333 have been positively addressed
by the Department of Natural Resources; and
WHEREAS, a period of time to test the operation policy is warranted,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of St. Louis
Park hereby withdraws its request for a public hearing as requested in Resolution
No. 7333 with the understanding that the residents of St. Louis Park through the
City Council can request at any time a further review of the Headwaters Control
Structure Management Policy if the facts demonstrate that the balance of water
between lake levels and creek flows becomes inordinately unfair.
