LOUIS PARK ORDINANCE CODE RELATING TO ZONING TO PERMIT AN AUTOMOTIVE SERVICE CENTER FOR PROPERTY LOCATED IN THE B-2, BUSINESS DISTRICT, AT 5125 MINNETONKA BOULEVARD BE IT RESOLVED BY the City Council of the City of St. Louis Park: Findings 1. Daryl Ray Borneman has made application to the City Council for a special permit under Section 14-156(18) of the St. Louis Park Ordinance Code for the purpose of operating an automotive service center located at 5125 Minnetonka Boulevard for the legal description as follows, to -wit: Lot 1, in Auditors Subdivision No. 53, except the South 54 feet 2. The City Council has considered the advice and recommendation of the Planning Commission (Case No. 82 -94 -SP) and the effect of the proposed automotive service center on the health, safety and welfare of the occupants of the surrounding lands, existing and anticipated traffic conditions, the effect on values of properties in the surrounding area, the effect of the use on the Comprehensive Plan, and compliance with the intent of the Zoning Ordinance. 3. The Council has determined that the proposed automotive service center as provided for and conditioned herein will not be detrimental to the health, safety, or general welfare of the community nor will it cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding property values, and the proposed automotive service center is in harmony with the general purpose and intent of the Zoning Ordinance and the Comprehensive Plan. 1 Conclusion The special permit to permit an automotive service center at the location described is granted based on the findings set forth above and subject to the following conditions: 1. That the site be developed, used and maintained in accordance with Exhibit A, Site Plan; Exhibit B, Floor Plan; Exhibit C, Elevation Plan—North, East and West; and Exhibit D, Elevation Plan—South. 2. That a five foot wide sidewalk easement adjacent to Minnetonka Boulevard over the north 5 feet of said Lot 1, Auditors Subdivision No. 53 except the south 54 feet be granted by the applicant prior to issuance of a Certificate of Occupancy, 3. That all lighting be directed perpendicular to the ground and be shielded so that no direct rays are visible beyond the property. 4. That landscaping improvements be made in accordance with Exhibit A. 5. That there be no change in the configuration of the slope on the south side of the property and that existing trees be retained. 6. That there be no outdoor storage of trash or other materials at any time. 7. That the permit shall terminate on December 31, 1987. 8. That the exterior treatment of the building shall be allowed until December 31, 1987, because of the termination date of the special permit. 9. That all improvements on the site be completed by May 15, 1983. Adopted by the City Council January 17, 1983 ATTEST: Reviewed for administration: [a.
