A RESOLUTION GRANTING SPECIAL PERMIT UNDER SECTION
14-124.101 OF THE ST. LOUIS PARK ORDINANCE CODE RELATING TO
ZONING TO PERMIT CONVERSION OF A PORTION OF THE BUILDING
FROM OFFICE TO STORAGE AND REPAIR OF DREDGING EQUIPMENT
WITHIN THE BUILDING FOR PROPERTY LOCATED IN THE PUD,
PLANNED UNIT DEVELOPMENT DISTRICT, AT 5105 WEST 35TH STREET
BE IT RESOLVED BY the City Council of the City of St. Louis Park:
Findings
1. Mud Cat Division of National Car Rental has made application to the City
Council for a special permit under Section 14-124.101 of the St. Louis Park Ordinance
Code for the purpose of converting a portion of the building from office to storage
and repair of dredging equipment within the building located at 5105 West 35th Street
for the legal description as follows, to -wit:
Lot 2 Block 3, Belt Line Industrial Park, according to the plat thereof,
Hennepin County, Minnesota
2. The City Council has considered the advice and recommendation of the
Planning Commission (Case No. 82 -91 -SP) and the effect of the proposed conversion
on the health, safety and welfare of the occupants of the surrounding lands, existing
and anticipated traffic conditions, the effect on values of properties in the surrounding
area, the effect of the use on the Comprehensive Plan, and compliance with the intent
of the Zoning Ordinance.
3. The Council has determined that the proposed conversion will not be
detrimental to the health, safety, or general welfare of the community nor will it
cause serious traffic congestion nor hazards, nor will it seriously depreciate surrounding
property values, and the proposed conversion is in harmony with the general purpose
and intent of the Zoning Ordinance and the Comprehensive Plan.
Conclusion
The special permit to to permit the conversion of a portion of the building from office
to storage and repair of dredging equipment within the building at the location described
is granted based on the findings set forth above and subject to the following conditions:
1. The site shall be developed, used and maintained in accordance
with Exhibit A, Mud Cat Facility Lot Improvement, dated
8-30-82.
2. Materials to be stored outside shall be limited to the dredges
and necessary ancillary equipment such as piping. With the
exception of the dredges themselves, no items stored on the
site shall be piled or otherwise placed so as to exceed a
height of six feet.
3. Lighting of the site shall not exceed a height of 25 feet and
shall employ the light fixtures which direct the light rays
perpendicularly to the ground.
4. The interior of the building may be used for offices, storage
and repair facilities.
5. All improvements on the site shall be completed by May 30,
1983.
